국문 초록

本文对中国学校体育伤害事故的保险救济制度进行了探讨。第一部分在全面分析体育伤害保险的概念、特点的基础之上，对中国学校体育伤害保险制度进行了探讨。首先，参考国外立法与实践，提出体育伤害保险的概念及特征；然后结合中国的现状提出中国现有的学校体育伤害保险制度存在的问题；最后，针对中国存在的问题提出创设学校体育伤害保险的具体方法及完善建议。第二部分在介绍侵权责任保险的基础之上，对中国体育伤害事故责任保险制度进行了探讨。首先，对侵权责任的概念进行了界定，并介绍其分类和性质。其次，通过对主要国家法律规定的分析，归纳出侵权责任保险的适用原则。再次，通过比较法的研究和理论分析，论述了侵权责任保险的承保范围及投保方式。最后，通过对现实问题的分析，提出中国构建体育伤害事故责任保险制度的具体构想。笔者认为，在学校体育活动伤害事故频发的今天，完善学校体育伤害保险和责任保险制度，对于推动体育保险产业的发展，保障受害人的权利，维护学校正常教学秩序，推动学校体育教学事业的发展具有重大意义。

영문 초록

This article probes into the mechanism of athletics hurt insurance. In the first part, this article tells about the basic properties of athletics hurt insurance, such as the definition and characteristic. On the base, the article probes into the system of school athletic hurt insurance in China. It first gives the definition and characteristic of such a kind of insurance, with reference to foreign legislation and practice. and then points out the problems that exist in China’s current athletic insurance mechanism combined with the situation in China. At last, it gives some advice on how to set up the athletic hurt insurance and how to improve it concerning to the problems in China’s system. In the second part, based on the introduction to introduces tort liability insurance, this article probes into the system of athletic hurt liability insurance in China. First, it gives a definition of this insurance and also the category and quality of it. Then, it comes to the conclusion of the principle of tort liability insurance, with the analysis of legislation of important countries. Then with the analysis, concludes the scope of cover and how to insure. At last, it gives the concrete idea about setting up the system of athletic hurt liability insurance system in China, through analyzing realistic problems. The authors believe that since nowadays, the athletic hurt happens frequently in school, it is of great importance to improve the system of school athletic hurt insurance and the system of school athletic hurt liability insurance, in terms of pushing forward the development of school athletic insurance industry, protecting the rights of victim, insuring the regular order of teaching and driving the development of physical education in school.
