원활한 보훈 지원을 위한 군 의무기록 관리 평가 및 개선방안 연구

국문 초록

전역 군인이 국가유공자 신청을 했을 때 국가유공자에 해당하는지 여부를 결정짓는 핵심적인 서류가 바로 ‘의무기록’이다. 군 의무기록에는 당시에 군 의료기관에서 치료받았던 내용이 기술되어 있으므로 보훈심사시 의무기록을 통해서 군 복무와 해당 질병·부상 및 그 후유증과의 인과관계를 파악할 수 있다. 또한 오랜시간이 경과한 후에는 당시의 상황을 확인하는 것이 쉽지 않으므로 치료 내용 및 질병·부상 발생 경위가 기록되어 있는 군 의무기록이 잘 보존되어야 한다. 이에 군 의무기록의 관리 현황을 살펴보고 평가 및 개선방안을 마련하고자 한다. 6.25 전쟁 당시에 발생한 군 의무기록은 제대로 보존되지 못했으며 베트남 참전 당시 군 의무기록 또한 국내에서는 보존되어 있지 않고 미국 의무기록센터에 일부 남아 있는 것으로 확인되어 관련자들의 국가유공자 등록에 어려움이 있어 의무기록 관리의 중요성이 대두되었다. 군 의무기록 관리와 관련된 규정은 1985년 12월에 첫 제정되어 다양한 변천사를 거쳐 2008년 9월 이후부터는 10년간 자대에서 보관 후 각 군 기록관으로 이관하여 영구 보존하고 있다. 해외 파병 시에는 민간 의료기관이나 외국 군 소속 군 의료기관에서 발생한 현지의 의무기록 사본을 파병한 우리 군 의무기록에 합철 하여 국내로 이관하도록 별도 규정하고 있다. 이를 통해 보훈 관련 요건심사 시 의무기록이 원활히 활용될 수 있도록 군의 의무기록 관리 규정이 잘 마련되어 있음을 알 수 있다. 의무기록 등 규정의 제·개정 사유는 시간 경과와 무관하게 알 수 있어야 연계성 있는 규정 수립이 가능함에도 사유 확인이 제한적이므로 향후에는 국방부 홈페이지 및 법제처의 국가법령정보 란에 개정 사유가 필수입력항목이 되도록 절차를 개선할 것을 제언한다. 우리 군인들은 군 복무 중 질병이나 부상을 당했을 때 본인이 원할 경우 민간 의료기관을 이용할 수 있다. 그러나 의료법적 의무기록 보존 기간인 10년이 경과한 이후 보훈 신청을 하게 될 경우는 민간 의료기관의 의무기록은 이미 존재하지 않을 가능성이 높다. 따라서 원활한 보훈 지원을 위하여 민간 의료기관의 의무기록 사본을 발급받게 하여 군 의무기록에 합철 해서 함께 기록관에 보존하는 방식을 검토할 필요가 있다.

영문 초록

It is ‘medical record that is the essential documents to decide whether a discharged soldier is qualified for national merit when he/she applies. As what kind of treatment was implemented by military medical institution was described in military medical record, the relation of cause and effect between military service and disease, injury, their aftereffect can be checked from the record in case of evaluating veterans affairs. Then, a military medical record that describes treatment and process of diseases and injury should be preserved in good way because it is not easy to check what happened at that time long after the incident. Thus, this research is willing to check and evaluate the management status of military medical record and set up the improvement plan. As the military medical records of Korean War and Vietnam War were not preserved properly, it is difficult to register them to national merit for the related people. Therefore, the importance of managing medical record rises. The regulations of managing military medical record management were established in December 1985 first time and the records have been kept at each military records center permanently after they stored at the individual camp for 10 years since September 2008 after passing through various events. In case of dispatching the troops aborad, they are separately regulated to transfer the copies of local medical records written in the civil medical institutes or military medical institutes belonged to foreign countries to Korea after combining them to medical records of the dispatched Korean troops. It is recognized that the regulations of military medical records are managed well so that they can be used actively in case of evaluating veterans affairs based on them. The study suggests to improve the procedure so that the reason for revision should be the mandatory input item in homepage of Ministry of Defense, and National law information center since it is currently limited to check the reason for establishing and revising the regulations such as medical records. In case that the soldiers themselves want to use the civil medical institutes where they were treated their diseases or injuries during the service term, the medical records are available. However, in case they apply for veterans affairs after passing 10 years that is the mandatory preservation period of medical record, it is highly possible for medical records not to exist at civil medical institutes. Thus, it is necessary to consider the way that preserves the copies of medical records issued from civil medical institutes after combining them to military medical records in the records center for active support of veterans affairs.
