사회복지 생활시설 종사자의 재해･안전실태와 법적 고찰

국문 초록

본 연구는 사회복지 생활시설 종사자에 관한 연구에서 그간 소홀히 다루어졌던 재해와 안전에 초점을 두고, 사회복지 생활시설 종사자의 근로실태, 작업 중 재해 및 그 처리 실태를 살펴보았고, 이와 관련된 법률들을 분석하였다. 재해 및 안전실태를 분석한 결과, 사회복지 생활시설 종사자들이 가장 흔하게 겪는 질환은 염좌․인대파열, 근골격계 질환이었다. 이 질환에 대한 산재 승인율은 원인에 따라서 달랐다. 업무상 사고의 경우는 승인율이 높았지만, 업무상 질환의 경우는 승인율이 낮았다. 다른 질환의 경우도 재해로 인한 경우는 산재 승인율이 높았지만, 업무상 질병으로 인한 경우는 승인율이 낮았다. 본 연구에서는 사회복지 생활시설 종사자의 안전하고 건강한 근무환경 조성을 위하여 다음과 같이 제언하였다. 첫째, 종사자의 산재보험 신청건수와 승인률이 높아져야 한다. 이를 위해서 중대재해만을 시설평가에 반영하고, 업무상 사유에 대해서 포괄적으로 해석해야 한다. 둘째, 산업안전보건법에서 사회복지시설에 대한 보건조치 항목을 확대 적용하고, 근로기준법에서 사회복지사업에 대한 근로시간 및 휴게시간의 특례 규정을 폐지해야 한다. 셋째, 사회복지 사업법에서 시설특성에 맞춘 안전교육, 산재보험법․노동법 교육을 보수교육에 포함시키도록해야 한다.

영문 초록

This study investigated the working conditions, the occurrence and the treatment of industrial accidents of care workers in social welfare residential facilities and analysed the laws and regulations in related with social workers’ health and safety. The results of analysis showed the most frequent diseases are muscular skeletal diseases as bruises and sprains. but the rate of approvement for industrial accident compensation insurance benefits are different from causes. The approvement of accidents at work was high but that of diseases was low. To afford working conditions which employees could work healthy and safety in residential facilities, suggestions of this study are followings. First, to extend application for industrial accident compensation insurance benefit and standard for recognition of occupational accidents, penalty for ordinary industrial accidents and injuries shouldn t be imposed in residential facilities with industrial disasters and it should be constructed the meaning of occupational causes comprehensively. Secondly, it should be extended health measures widely for caring workers and eliminated contracting-out for social worker and business places under 5 workers in Industrial Safety and Health Act and in Labor Standard Act. Finally, laws for health, safety and industrial accident, labor should be contained in continuing education with property of in social welfare residential facilities.
