행정심판의 간접강제 제도에 대한 검토 - 중앙행정심판위원회의 2024년 간접강제 사건을 중심으로

국문 초록

본 연구는 2024년 중앙행정심판위원회의 간접강제 결정 현황 자료를 분석하고, 인용 결정된 두 건의 사례를 심층 검토하여 행정심판법상 간접강제 제도의 운영 실태, 문제점을 파악하고 개선 방안을 제시하고자 하였다. 본 연구의 대상을 분석한 바에 따르면, 2024년 중앙행정심판위원회의 간접강제 결정 인용률은 3%에 불과하여, 행정심판 재결의 실효성을 확보하기 위한 간접강제 제도의 기능이 미흡한 것으로 나타났다. 행정심판 재결의 기속력에도 불구하고 일부 행정청은 재결 취지에 따른 처분을 이행하지 않거나 소극적인 태도를 보이는 경우가 있다. 또한, 간접강제의 사후적·간접적 구제 수단이라는 한계로 인해 행정청의 자발적인 재결 이행을 담보하기 어렵고 이는 신청인의 권리 구제 지연으로 이어진다. 이러한 문제점을 해결하기 위해, 본 연구는 과태료, 징계 등 재결 불이행에 대한 제재 강화, 직권 간접강제 도입 및 지연배상금 현실화 등 간접강제 제도 보완, 재결 이행 감독 강화와 직권 조사 활성화 등 행정심판위원회 역할 강화를 제안하였다.

영문 초록

This study analyzes the 2024 indirect compulsion decisions of the Central Administrative Appeals Commission of Korea, with an in-depth examination of two approval cases. The purpose is to identify the operational status and problems of the indirect compulsion system under the Administrative Appeals Act, and to propose improvement measures. The analysis revealed that the approval rate for indirect compulsion decisions by the Central Administrative Appeals Commission in 2024 was only 3%, highlighting several key issues: non-compliance with adjudications by administrative agencies, arbitrary interpretation of grounds for non-disclosure, and limitations of the indirect compulsion system itself. To improve adjudication compliance, this study recommends stronger sanctions and a supplemented indirect compulsion system. This includes ex officio initiation, realistic delay compensation, and a reinforced Commission role in monitoring, along with expedited decision-making for indirect compulsion.
