국문 초록

본 연구에서는 인공지능 시대의 저작권법과 공정이용의 이해 상충에 관해 출판 분야의 사례를 중심으로 파악하고자 하였다. 출판 분야 디지털 아카이브 사례 분석을 통해, 공정이용과 인공지능 시대의 저작권을 위한 법적 제도적 대비점이 무엇인지 살펴보고자 하였다. 이를 위해 생성형 AI의 학습데이터 분석에 활용가능한 국내의 한국고전종합DB구축사업 사례, 말뭉치 사업의 사례를 중심으로 디지털 아카이브 사례분석을 한 결과, 공공재로서 디지털 아카이브가 AI 시대에 중요한 학습 데이터 자원이 될 수 있음을 알 수 있었다. 다만, 공공이용을 위한 디지털 아카이브 중에 저작권 침해 문제가 발생할 수 있음을 파악하였다. 둘째, 생성형 인공지능에서 공정이용 법리의 유효성을 파악하고, 미디어 기업- 테크 기업 간 콘텐츠 라이선스 신규 체결과 AI 관련 보상체계 마련 및 저작권 재검토 필요성이 대두됨을 제안하였다. 마지막으로 향후 인공지능과 관련한 법적 제도적으로 대비해야 할 부분에 대해 민간과 정부 차원에서 노력을 기울여야 할 사항이 무엇인지 모색할 수 있었다. 이 연구는 디지털 아카이브에 대한 다양한 사례 분석을 통해 향후 후속 연구를 위한 기초 자료를 제공하였으며, 연구 한계점과 제언을 제시하였다.

영문 초록

This study aimed to grasp the conflict between copyright law and fair use in the AI era, focusing on cases within the publishing industry. Through an analysis of digital archive cases in the publishing field, we sought to examine the legal and institutional preparedness required for fair use and copyright in the age of artificial intelligence. For this end, a case analysis of digital archives was conducted, focusing on the Korean Classical Literature Comprehensive Database Construction Project and the Corpus Project, both of which provide training data for generative AI. The results revealed that digital archives, as public goods, can serve as crucial training data resources in the AI era. However, it was also identified that copyright infringement issues may arise within digital archives intended for public use. Second, the study assessed the validity of fair use principles in generative AI and proposed the need for new content licensing agreements between media and tech companies, the establishment of AI-related compensation systems, and a reexamination of copyright laws. Finally, we explored what efforts should be made at both the private and government levels regarding future legal and institutional preparations for AI. This study provided foundational data for subsequent research through diverse case analyses of digital archives and presented its limitations and recommendations.
