국문 초록

본 논문은 생성형 인공지능(AI)의 학습 데이터 활용에서 발생하는 저작권법과 개인정보 보호법의 이중 허들 문제를 분석하였다. 특히 권리자의 동의 확보가 현실적으로 불가능한 상황에서 중요성이 부각되는 예외 규정인 저작권법상 ‘공정이용(fair use)’과 개인정보 보호법상 ‘정당한 이익(legitimate interests)’의 요건을 비교하였다. 연구 결과, 두 예외 규정은 서로 다른 철학적 기반과 판단 구조를 가진다. 저작권법상공정이용은 창작자 보호와 문화 발전의 균형을 추구하며, 이용 목적의 변형성, 저작물의 성격, 이용량, 시장 영향 등 4가지 요소를 종합적으로 고려한다. 반면 개인정보 보호법상 정당한 이익은 인격권을 기본권으로 보호하며, 목적의 정당성, 필요성, 균형성 테스트라는 3단계 심사를 통해 개인정보처리자의 이익이 정보주체의 권리보다 명백히 우선할 것을 요구한다. 본 논문에서는 두 예외 규정이 AI 학습 데이터 맥락에서 상당한 기능적 상관관계를 보임을 발견한 바 있다. 공정이용의 ‘이용 목적과 성격’은 목적의 정당성, ‘이용된 부분의 양과 질’은 필요성(최소 침해의 원칙), ‘시장에 미치는 영향’은 균형성(비교형량)과 각각 대응되며, ‘저작물의 성격’은 데이터 민감도 평가와 비교하여 분석할 수 있다. 개인정보보호위원회는 ‘정당한 이익’을 근거로 공개된 개인정보의 AI 활용 가능성을 제시하면서도 기술적 안전조치를 병행하도록 요구하고 있다. 저작권에 관한 법적 불확실성을 해소하기 위해서 TDM 면책 규정 도입을 검토할 필요가 있다.

영문 초록

This article conducts a comparative analysis of the double hurdle presented by copyright law and personal data protection law concerning the use of training data for generative artificial intelligence (AI). Specifically, it compares the requirements of ‘fair use’ under copyright law and ‘legitimate interests’ under personal data protection law. These are exception provisions that become crucial in circumstances where obtaining consent from rights holders is practically infeasible. The two exception provisions possess distinct philosophical foundations and analytical frameworks. Fair use under copyright law seeks to balance the protection of creators with the advancement of culture, and it involves a holistic consideration of four factors: the purpose and character of the use, the nature of the copyrighted work, the amount of the portion used, and the effect of the use upon the potential market. Conversely, the ‘legitimate interests’ provision in data protection law is grounded in the protection of personality rights as a fundamental right. It employs a three-step assessment—a legitimacy test for the purpose, a necessity test, and a balancing test—which requires that the interests of the data controller manifestly override the rights of the data subject. This article finds that the two exception provisions exhibit a significant functional correlation within the context of AI data training. The ‘purpose and character of the use’ factor in fair use corresponds to the legitimacy of purpose; the ‘amount and substantiality of the portion used’ aligns with necessity (the principle of minimum infringement); and the ‘effect on the market’ parallels the concept of balance (a comparative weighing of interests). Furthermore, the ‘nature of the copyrighted work’ can be analyzed in comparison to the assessment of data sensitivity. South Korea’s Personal Information Protection Commission (PIPC) has indicated the possibility of using publicly available personal data for AI development on the grounds of ‘legitimate interests’, while simultaneously requiring the implementation of technical safeguards. To resolve the legal uncertainty surrounding copyright, it is necessary to consider the introduction of a statutory text and data mining (TDM) exemption.
