국문 초록

우리 사회에서 출산율은 계속 낮아지고 고령사회는 깊어지고 있다. 저출산은 필연적으로 생산활동인구를 감소시켜 지속적인 경제성장을 위협하고, 또 고령사회와 연계하여 인구구조의 불균형이 예견되고있다. 인구구조의 불균형으로 인하여 세대 간의 형평이 상실되는 상황을 헌법 및 사회보장법의 규범 구조에 편입하여 설명하여야 한다. 이로써 고령사회에서 적합한 의제가 형성될 수 있다. 그리고 이에 기초하여 사회과학의 이에 관한 문제인식과 소통하면서 규범적 기준을 제시하고, 이에 따라 사회과학의 연구성과를 검토하여야 한다. 고령사회에서 현재 노인복지를 위한 투자는 미래 국가의 재정 부담으로 남으며, 이러한 구조에 대한 이해에 기초하여 세대 간 형평에 친화적인 투자가 필요하다. 이에 예컨대 건강보장에 있어서 공공보건을 확충하여야 한다. 세대 간 형평은 사실은 세대 내 형평의 연장선상에 있다. 세대간 형평을 위하여 기존의 복지생산의 목표를 다시 정리하고 이에 상응하여 체계를 구성하여야 한다. 세대 간 형평은 개별 복지제도 자체 내에서 조정되어야 한다는 점을 특히 연금보험에서 자녀양육을 중심으로 살펴보았다. 노령은 전통적인 사회적 위험의 요소이지만 동시에 새로운 상황에서 문제가 제기되어야한다. 고령사회에서 노인의 기대수명이 높아지고 은퇴 시점 이후 공적 복지에 의존하여야 하는 기간이길어졌지만 공적 복지가 이를 부담하는 능력은 낮아지고 있다. 이에 노령 이후의 시기에도 계속 노동을통하여 스스로 복지를 생산하고, 또 복지 기대권을 축적할 수 있도록 취업지원 및 알선 등이 노동의 권리를 구성할 수 있어야 한다. 이에 노동의 권리는 인간다운 생활을 권리와 밀접하게 연계하여 구성되어야한다. 노인이 인간의 존엄을 위하여 특히 가족이 아닌 요양시설의 낯선 환경에 놓여지고 자기결정능력이제한적인 상태에서 요양을 받기 때문에 자기결정권과 인권이 소홀히 될 수 있다는 점을 주목하여야 한다.

영문 초록

Especially since the 2000s, fertility rate in Korea has continued to decline andthe aged society has deepened. Declining fertility inevitably shrinks the working-agepopulation, threatening sustained growth and leading to demographic imbalancesassociated with an aged society. The normative approach to aged societies is dual.On the one hand, the loss of inter-generational equality due to demographic imbalancemust be explained and incorporated into the normative structure of constitution andsocial security law. This way, an appropriate agenda for an aging society shouldbe formed. Based on this, normative standards should be proposed while communicatingwith social science's recognition of the problem and reviewing social science'sresearch achievements accordingly. This article first presents the structure of theaged society, which has various effects on the operation of national finances. Itrevealed that inter-generational equality in welfare production is actually an extensionof intra-generational equality. Then, in order to maintain inter-generational equality,it was attempted to reorganize the existing goals of welfare production andcoordinate the system accordingly. The criteria for inter-generational equality shouldbe considered within the welfare system itself, with a particular focus on childrearing. As for the micro-legal relations of the elderly, the elderly are a traditionalsource of social risk, but at the same time, the issue must be raised in a new context.In an aged society, the life expectancy of the elderly is increasing, which meansthat the length of time they have to rely on public welfare is prolonged, but thefinancial ability of public welfare is limited. The possibility of producing andcoordinating welfare through labor must be ensured. The right to work must thereforebe framed in close connection with the right to a decent life. It should be notedthat the right to self-determination and human rights may be neglected when peopleare placed in care, especially in unfamiliar environments outside of their familiesand with limited capacity for self-determination.
