국문 초록

정당방위는 국가가 법익을 보호하지 못하는 긴급한 상황에서 예외적으로 개인의 방위행위를 정당화하는 제도로서 ‘침해의 현재성’은 엄격하게 해석되어야 한다. 그러나 가정폭력이 장기간 반복되며 특정한 상황이나 행위가 지속적으로 침해로 이어져 왔다면, 일정한 조건이 충족될 경우 ‘곧’ 침해가 재현될 것이라는 사실을 객관적으로 예견할 수 있다는 점에 주목할 필요가 있다. 일상적 공간에서 일정한 조건이 충족될 때마다 반복되어 온 가정폭력은 ‘정형화된 폭력’이라 할 수 있다. 이러한 정형성은 동일한 조건이 갖추어졌을 때 침해가 임박했다는 예측을 가능하게 하며, 침해가 실질적으로 종료된 것인지, 혹은 단지 일시적으로 중단된 상태에 불과한지를 객관적으로 판단할 수 있는 근거가 된다. 이때 전자는 침해가 임박했는지를, 후자는 침해가 종료되었는지를 판단하는 데 각각 작용한다는 점에서, 침해의 시기와 종기에 따라 ‘계속위험’의 의의를 구분해볼 수 있다. 본 논문은 정당방위에 있어서 ‘침해의 현재성’ 요건을 엄격하게 해석하되, 정형화된 가정폭력 상황에서 ‘계속위험’이 현재성 판단에 어떠한 의의를 가질 수 있는지를 검토한다.

영문 초록

Self-defense is a legal doctrine that exceptionally justifies an individual's defensive actions in urgent situations where the state fails to protect legal interests. Among its requirements, the condition of “immediacy of infringement” is generally interpreted strictly. However, in cases where domestic violence has occurred repeatedly over a long period and certain situations or behaviors have consistently led to such infringement, it becomes necessary to consider the objective foreseeability of imminent harm when the same conditions are met again. Repeated domestic violence occurring under recurring conditions in everyday spaces may be characterized as “patterned violence.” Such regularity enables a predictive assessment that infringement is imminent when specific conditions are present. It also provides a basis for objectively determining whether the infringement has truly ended or is merely in a temporarily suspended state. The former is relevant in assessing the imminence of the threat, while the latter relates to whether the threat has ceased, thereby allowing for a conceptual distinction in the meaning of “continuing danger” depending on the timing and conclusion of the infringement. This paper strictly interprets the requirement of immediacy in self-defense and examines how the concept of continuing danger may hold significance in assessing immediacy within the context of patterned domestic violence.
