국문 초록

21세기로 들어서면서 핵가족화와 고령화 등으로 치매인구의 증가가 큰 사회문제로 대두되었다. 이는 교도소 인구의 구성에도 영향을 주어 치매수용자도 급증하게 되어 각국의 교정정책도 이에 대응하고 있다. 마찬가지로 한국 교정정책도 영향을 받고 있다. 한국의 교정치매정책결정과정에 영향을 주는 외부 요인은 권위가 있는 기구들의 권고안들이 있으며 이에는 국가인권위원회와 유엔의 피구금자 처우에 관한 최저기준규칙, 세계알츠하이머협회의 권고안 등이 있다. 그러나 이들 권고안의 내용을 절대시하는 베이컨의 “극장의 우상(劇場의偶像)“에서 탈피하여 그대로 추종하기 보다는 권고안의 문제점도 비판적으로 살펴보는 것은 올바른 교정치매정책의 수립에서 필요하다. 따라서 권고안들에 대해서 비판적 관점에서 접근할 필요가 있다. 가령 권고안들은 관료사회학적 관점의 결여가 크며 또한 교정치매의 예방과 치료에서 큰 역할을 하는 정신건강간호사와 교정간호사의 역할에 대해 완전히 간과하고 있다. 이 점에 착안하여 본 논문에서는 교정정책에 영향을 줄 수 있는 권위있는 기구들의 권고안의 내용을 서술한 뒤에 문제점을 통시적(通時的),학제적(學際的),전문적인 관점에서 독창적으로 비판하였다. 나아가 교정치매정책에 대한 이러한 권위있는 기구들에 대해 오히려 필자가 제안을 제시하였다. 목적은 교정치매정책에 대한 적절한 정책을 위해 서술되었으며 연구방법은 문헌연구이며 접근법은 학제적 접근으로 하였다. 중점을 둔 연구분야는 한국의 교정치매정책에서 가장 큰 영향을 줄 수 있는 국가인권위의 권고안에 대한 상세한 검토와 비판에 두었다. 결론에서는 교정치매정책의 방향을 독창적으로 제시하였으며 그 핵심은 교정치매친화적 교정간호레짐의 확립이다.

영문 초록

Entering the 21st century, the increase in the number of people with dementia emerged as a major social problem due to the nuclear family and aging population. This also affects prisons, which leads to a surge in dementia inmates, and each country's correction policies are responding to this, Similarly, Korea's corrective policy is being affected. External factors affecting the decision-making process of korean correction policy for dementia inmates include recommendations from authoritative bodies, including recommendations from the National Human Rights Commission and the United Nations and Alzheimer's Council. It is necessary to examine the problems of the recommendation rather than to follow the contents of the recommendation from the so-called Bacon's “idolatry of the theater”. Therefore, it is necessary to approach the recommendations from a critical point of view. For example, the recommendations lack a bureaucratic sociological perspective and overlook the role of mental health nurses and correction nurses, which play an important role in the prevention and treatment of correction policy for dementia inmates. Therefore, it is necessary to approach recommendations from a critical point of view. In this paper, after describing the contents of the recommendations of the organizations that can influence the correction policy, the problem was originally criticized from an interdisciplinary point of view.Furthermore, I have made recommendations for these authoritative organizations in correction policy for dementia inmates. The purpose of this study was to describe the appropriate policy for corrective dementia policy, and the research method was a literature review and the approach was an interdisciplinary approach. The focus was on reviewing and criticizing the NHRC's recommendations, which have a significant impact on corrective dementia policies. In conclusion, the direction of the correction dementia policy was suggested, and the key is the establishment of correction dementia-friendly correction nursing regime.
