국문 초록

2020년에 제정된 북한의 ｢무인기법｣은 무인기(드론)와 관련된 연구개발, 제작, 반입, 검사, 등록, 관리 및 운용에 대한 체계적인 규제를 명시한 법률이다. 이 법은 국가 안보와 안전을 보장하고 무인기의 안전한 운용을 위해 다양한 절차를 설정하고 있다. 북한의 무인기 기술은 아직 초기 단계지만, 법적 인프라를 통해 국제 수준으로 발전할 가능성이 있다. 북한은 무인기를 대남정찰, 감시, 군사적 공격 등 다양한 목적으로 운용하고 있어, 대한민국의 영토주권과 국가안보에 중대한 영향을 미친다. 국제사회에서는 AI 기반무인기 공격의 법적 책임과 전쟁법 준수 문제에 대한 논의가 활발히 진행되고 있다. 이러한 논의는 북한에도 적용될 수 있으며, 국제적 협력과 대화가 필요하다. 본 논문에서는 북한을 대상으로 한 국제협약을 제안하며, 대한민국과 국제사회의 협력 중요성을강조한다.

영문 초록

The “Unmanned Aerial Vehicle (UAV) Law” of North Korea, enacted in 2020, establishes a comprehensive regulatory framework for the research, development, production, importation, inspection, registration, management, and operation of unmanned aerial vehicles (drones). This law aims to ensure national security and safety by setting forth various procedures for the safe operation of UAVs. Although North Korea's UAV technology is still in its early stages, the legal infrastructure in place offers the potential for its development to reach international standards. North Korea employs UAVs for a range of purposes, including reconnaissance, surveillance, and military attacks against South Korea, thereby posing a significant threat to the territorial sovereignty and national security of the Republic of Korea. The international community has been actively discussing issues related to the legal responsibility for AI-based UAV attacks and the adherence to the laws of war. These discussions could also be applicable to North Korea, highlighting the need for international cooperation and dialogue. This paper proposes the establishment of international agreements targeting North Korea and emphasizes the importance of cooperation between South Korea and the international community in addressing these security concerns.
