국문 초록

Wildlife is closely related to human survival and development. In the process of promoting the construction of ecological civilization, the protection of wildlife resources through criminal law is indispensable. The current criminal legislation on the protection of wildlife resources in China has problems such as the scope of protection of wildlife resources needs to be further broadened, the consumption of wildlife urgently needs to be regulated by criminal law, and the criminal sanctions are not comprehensive. Improvements should be made in terms of moderately expanding the scope of protection of wildlife resources, creating the crime of illegal consumption of wildlife, perfecting criminal law sanctions, adding corresponding restorative sanctions, and implementing parallel penal and non-penal sanctions.

영문 초록

野生动物与人类生存发展息息相关。在推进生态文明建设进程中，通过刑法保护野生动物资源是不可或缺的。当前我国野生动物资源保护的刑事立法中，存在野生动物资源保护范围有待进一步拓宽、食用野生动物行为亟需刑法规制、刑罚制裁方式不全面等问题。应当从对野生动物资源的保护范围适度扩大化、增设非法食用野生动物罪、完善刑法制裁措施、增加相应的恢复性制裁手段，实行刑罚制裁与非刑罚制裁方式并行等方面加以完善。
