국문 초록

대한예수교장로회의 총회 법리부서 일을 하면서 느낀 것은, 재판국의 판결에 대한 불신이 점증하고 있다는 것이고, 이로 인하여 당사자들이 처음부터 사건을 국가 법원으로 가져가는 사례가 많아지고 있다는 것이다. 참으로 안타까운 일이 아닐 수 없다. 이러한 현상이 나타나고 있는 것은 예장통합의 헌법 및 헌법시행규정(이하 ‘교단 헌법’이라 함)에 문제점이 있기 때문이다. 이하에서는 권징재판의 구조와 문제점을 살펴보기로 하되, 권징재판의 구조 부분에 대해서는 주요 규정을 소개하는 것으로 대체하고, 권징재판의 문제점 부분은 주로 개선방안 검토 차원에서 살펴보았다. 문제점과 부족한 점, 단점이 없는 제도가 이 세상에 있을 리 없지만, 그러나 이를 극복하려는 노력이 없다면 그 문제점은 개선될 수 없을 것이고, 그로 인한 피해는 결국 그 구성원에게로 돌아갈 것이다. 교단 헌법에는 지금까지 언급한 것 외에도 많은 문제점이 있다. 그렇지만 누군가 이를 극복하려는 노력을 기울인다면 언젠가는 그 문제점은 더 이상 문제되지 않을 날이 올 것이고, 그로 인한 과실은 결국 그 구성원에게로 돌아갈 것이다. 이번 포럼이 권징재판제도 개선에 도움이 될 수 있기를 바란다.

영문 초록

What I felt when I was working as a general council member of the Korean Presbyterian Church is that there is growing disbelief in the judgment of the Court of Cassation and that there is a growing number of cases where the parties take the case from the outset to the court. It is a pity. This is because there is a problem with the Constitution of the Presbyterian Consolidation and the Constitution of the Constitution (hereinafter referred to as the “Constitution of the denomination”). In the following, we examine the structure and problems of the junta trial, but the structural part of the junta trial is replaced with the introduction of the main provisions. There are no problems, shortcomings, or shortcomings in the world, but if there is no effort to overcome them, the problem will not be improved and the damage will eventually return to its members. The Constitution of the denomination has many problems other than those mentioned above. But if someone tries to overcome this, someday the problem will no longer be a problem, and the resulting error will eventually return to its members. I hope this forum can help improve the disciplinary system.
