부교역자의 교회법상의 지위와 성경적 모델

국문 초록

“부교역자”라고 부르는 호칭은 교회법상에서 공식적으로 존재하는 명칭은 아니지만 통상적으로 담임 목사를 보좌하여 교회의 사무를 돕는 사역자들을 일컫는 말이다. 현행 교회법에서 규정하는 부교역자의 지위를 보면 교회 공동체의 일원으로서 봉사의 직을 감당하는 사람이라고 보기보다는 교회의 필요를 따라 고용한 유급 직원으로 볼 수밖에 없다. 그러기 때문에 최근 이어진 세속 법정에서 부교역자들을 사역자가 아니라 근로자로 평가한 것은 교회법상으로 보아도 인정할 수밖에 없는 측면이 있다. 교회가 부교역자들을 근로자로 취급하지 않고 또 세상에서도 부교역자들이 근로자가 아니라 사역자로서 평가받게 하려면 현행 교회법을 수정하여 부교역자들을 교회 공동체의 일원이 될 수 있도록 그리고 자율적으로 사역할 수 있도록 하는 장치가 보완되고 마련되어야 할 것이다. 부목사의 경우 담임목사나 당회가 고용을 결정하는 것이 아니라 성도들에 의해서 공동의회의 결의로 청빙하는 과정을 거치게 한다면 공동체의 일원으로서 인정될 수 있을 것이다. 또 담임 목사나 장로와 더불어 당회원이 되어 당회 안에서 협의의 당사자가 된다면 담임 목사에 종속된 근로자가 아니라 사역자로서 지위를 보장받을 수 있을 것이다. 전도사를 비롯한 다른 사역자들의 경우는 제도적 보완을 통해서 사역자로서 인정받기는 어려워 보인다. 그러기 때문에 유급 직원으로 꼭 필요한 업무만 그들에게 의무로 부과하고 개인적인 신앙생활의 영역은 완전히 본인의 자율에 맡기는 것이 맞다. 하지만 교회는 전도사들이 유급 직원으로서 일할지라도 그들을 사역자로서 존중해주어야 할 것이다. 그래야 전도사들이 세상 법정에서 사역자로 인정받느냐 근로자 취급을 받느냐의 문제를 떠나서 사역자로서 스스로 자존감을 가지고 일을 할 수 있게 될 것이다. 성경에 나오는 모세와 아론의 동역 모델, 모세와 방백들의 동역 모델, 그리고 모세와 여호수아의 동역 모델 등은 오늘날 교회 안에 좋은 동역의 모델이 될 것이다. 하지만 사울과 다윗의 동역 모델 속에서 사울의 모습은 반면교사로 삼아야 할 부분이 큰 동역 모델이다.

영문 초록

The term “assistant pastors” is not an official title in church law, but it is commonly used to refer to ministers who assist the senior pastor in the church. According to current church law, the position of assistant pastors seems more like an worker hired to fulfill the special needs of the church rather than an volunteer who does his responsibility as a member of the church. Therefore, it is reasonable that the secular courts have recently evaluated assistant pastors as employees rather than ministers even in the context of church law. If the church wishes to treat assistant pastors not as employees but as ministers in the church and also they could be evaluated as ministers rather than employees even in the secular context, it is necessary to adjust the current church law so that they should be integral members in the community of the church and also serve autonomously. For associate pastors, if the process of hiring is determined not by the senior pastor or the church council but through a resolution of the congregational meeting, they could be recognized as integral members of the community. Furthermore, if they become members of the consistory along with the senior pastor and elders and participate as a party in discussions within the consistory, they can secure a position as a minister, not as an employee dependent on the senior pastor. For other workers, including non-ordained pastor, it seems challenging to gain recognition as ministers through institutional improvements. For this reason, it is appropriate to impose only necessary duties as obligations for paid employees and to leave the rest of the personal spiritual life within the church completely to their autonomy. However, the church should treat non-ordained pastors with respect as ministers, even if they work as paid employees. This will help them develop selves-esteem as ministers, regardless of whether secular courts recognize them as such. Some collaborative models between Moses and Aaron, between Moses and officials over thousands, hundreds, fifties, and tens, and between Moses and Joshua found in the Bible would serve as excellent models of collaboration within the today's church. However, within the collaborative model of Saul and David, Saul's example is a significant model of reflection.
