국문 초록

이 논문은 제38차 연방의회(1863-1865) 회기 동안 특히 1864년을 전후하여 일어나고 있는 여러 개혁논의 속에서 당시의 시대정신과 소명을 확인해보는 것이다. 이 시점에 대한 주된 역사 서술은 수정조항(수정헌법제13조)의 통과 준비와 그 성공을 살펴보는데 주안점을 두고 있다. 그러나 필자는 이에 대한 의문을 제기하고자 한다. 당시의 여러 공론장을 통해서 일어나고 있는 논쟁과 갈등은 여전히 해결될 수 없는 문제로 남아 있는 이 국가의 정체성과 주권(states Right)에 대한 격돌임을 확인할 수 있기 때문이다. 이 부분에 대한 세심한 고려와 분석이 없이는 수정조항의 비준과 실행으로 가는 그 험난하고 복잡한 노정은 이해하기 어렵다. 많은 제한과 조건이 붙었지만 유명한 1863년 노예해방령으로 가시적으로 성과(?)를 이뤘음에도 불구하고, 연방헌법에 수정조항을 각인하는 문제에 대통령이 머뭇거리고 있었던 이유도 주권에 대한 그의 고민에서 출발하고 있다. 본 논문은 비록 일시적인 기간이지만 왜 대통령이 이전까지 그렇게도 강조한 “국민주권론”에서 다시 “주권론”으로 한발 후퇴하게 된 이유를 설명해 볼 것이다.

영문 초록

This critical essay aims at the understanding the Civil War and Reconstruction and finally President Lincoln’s thinking about the Thirteenth Amendment. President Issued the Emancipation Proclamation on January 1, 1863. and so all Confederate slaves but a few certain areas and borderlines states were freed. Therefore, so many black soldiers had taken part in battles such as Port Hudson and MilliKen’s Bend, Louisiana, and Fort Wagner, South Carolina. On December 8, Lincoln introduced so-called “Ten-Percent Plan of Reconstruction” and the Proclamation of Amnesty and Reconstruction. All these great reform movements and the military reconstruction had great affected into black people in the Confederate areas. And the reform-mind Congress had visioned a ultimate settlement, the Thirteenth Amendment, which had been approved and ratified and in the finally added into the U. S. Constitution. In the course of these increasingly added reform movements, I try to understand why President never accepted all the reform programs acquiescently and firstly in the very historic movement. why he taken more careful and extended observation about States Right, contrary to the past statements as the Emancipation Proclamation and Gettysburg Address.
