국문 초록

본고는 그간 소홀히 다루어져 왔던 길버트법을 재조명하는데 그 목적이 있다. 강제성이 없는 수권법적인 성격을 지녔다는 이유로 길버트법의 영향력은 오랜 기간 과소평가 되어 왔다. 단지 이 법이 지닌 인도주의적 측면만 강조되어 왔을 뿐이다. 하지만 이 법을 입안한 토마스 길버트의 개혁은 단순히 인도주의적 구빈 체제를 만들기 위한 것이 아니었다. 그는 구빈 체제 전반에 대한 대대적인 혁신을 추구했다. 그러나 1765년 첫 입법 시도가 불발되면서 그의 개혁은 점차 온건한 방향으로 나아갔다. 1782년 제정된 길버트법은 초기 개혁안에서 크게 후퇴한 내용을 담고 있을 뿐 아니라 전국에 개혁을 의무화하지 못한 대신 개혁의 권한을 지방 정부에 부여했다. 이러한 한계에도 불구하고 길버트법이 수용된 범위는 기존 연구가 밝힌 것 보다 광범위했고 햄프셔에서만 약 40개의 교구가 길버트법을 채택했다. 그리고 길버트법을 받아들인 목적 역시 인도주의적인 것에 한정되지 않았으며 구빈 비용 감축 및 빈민 노동 장려 등 다양했다. 심지어 길버트법은 구빈 체계의 일대 혁신을 가져온 1834년 신빈민법 이후에도 그 명맥을 유지하였고 일부 지역에서 여전히 확고히 견지되고 있었다.

영문 초록

This paper aims to shed new light on Gilbert’s Act, which has been neglected in exsiting studies. The influence of Gilbert’s Act has long been underestimated due to its nature as a permissive act without coercive force. However, the reform of Thomas Gilbert, who drafted this act, were not merely intended to create a humanitarian relief system. He sought a comprehensive overhaul of the entire poor relief system. Yet, after the failure of his first legislative attempt in 1765, his reform gradually took a more moderate direction. Gilbert’s Act, enacted in 1782, not only represented a significant retreat from the original plan but also failed to mandate the reform nationwide, instead granting local governments the authority to implement the reform. Despite these limits, the extent to which Gilbert’s Act was adopted was far more widespread than what previous research has revealed. In Hampshire, about 40 parishes adopted Gilbert’s Act. Moreover, the motivations for its adoption were not limited to humanitarian concerns, but diverse, including the reduction of poor relief costs and the encouragement of labor among the poor. Remarkably, Gilbert’s Act continued to persist even after the 1834 New Poor Law, which brought a major overhaul to the poor relief system, and in some areas, it remained firmly upheld.
