북한 도발 시 “단호한 대응”과 “확전 방지” 조화 방안

국문 초록

2010년 11월 23일 연평도 포격 이후 “단호하게 대응하되 확전을 방지하라”라는 대통령의 상충된 지침과, 교전규칙에 집착하여 공군기로 적 포진지를 사격하지 못하였다는 군의 설명이 국민들의 호된 질책을 받았다. 그러나 이러한 지침이나 설명은 오히려 타당한 것으로 앞으로의 도발 대응에도 적용되어야 한다. 이러한 측면에서 자위권과 교전규칙의 개념을 정리한 후, 천안함 폭침과 연평도 포격 시 한국군이 실제적으로 적용했던 사례를 분석하였고, 특히 북한의 핵무기 사용, 수도권에 대한 제한적 공격, 서해 5개 도서에 대한 상륙공격, 주요 도시에 대한 미사일 공격 등의 상황을 예상하여 “단호한 대응”과 “확전 방지”를 어떻게 조화시킬 것인지를 분석하였다. 한국은 자위권의 적극적 행사 필요성을 유념하는 가운데, 북한 미사일에 의한 공격이나 핵 및 화생무기 공격과 관련하여 응징공격까지 고려할 수 있어야 하고, 필요할 경우 예방적 자위권 차원의 선제공격도 검토할 필요가 있다. 철저한 대비태세를 통하여 북한이 어떠한 형태로 도발을 하더라도 금방 무력화시키는 것이 단호한 대응과 확전 방지라는 두 가지 요소를 가장 자연스럽게 충족시키는 방안이다.

영문 초록

There raised huge criticisms regarding President Lee, Myung-bak's directive of “Resolute Responses and Prevention of Escalation” in response to the North Korean shelling on Yeonpyeong Island on November 23, 2010. Korean military also was criticized for its passive application of the rules of engagement. However, they need be reevaluated and recognized as right ones, and be applied regarding possible North Korean provocations. This article introduced the right of self-defense including anticipatory self-defense and rule of engagement as theoretical basis for an analysis. Then, it analyzed the application of right of self-defense during the sinking of South Korean warship, Cheonan, on March 26, 2010, and bombing on Yeonpyeong Island. It reviewed plausible options South Korea could take in response to the North Korean provocations such as the use of nuclear weapons, limited attack against Seoul, amphibious operations toward islands in the West Sea and missile attack on South Korean cities. This paper found that South Korean people need to clearly understand the concept of the right of self-defense and be more resolute in the application of it. It recommended that retaliatory attacks or preemptive actions should also be included in the response options. It concluded that reliable combat readiness which can neutralize any North Korea provocative attempts should be emphasized.
