국문 초록

퇴직연금제도의 정착과 근로자의 수급권 보호 강화 차원에서 퇴직연금 수탁자와 관련된 제반 리스크를 정책당국이 어떻게 적절히 관리감독 하느냐가 향후 중요해진다. 우리나라의 경우, 감독단계 별로 관리감독이 이루어지지 않고 있고, 정교한 리스크감독관련 규정도 아직 마련되지 않고 있다. 따라서 수탁자 리스크의 발생가능성 정도, 수탁자 리스크에 대한 감독수준을 우리나라 퇴직연금제도의 특성과 현실적인 여건 등을 감안하여 향후 종합적으로 수립할 필요성이 있으며, 이런 맥락에서 리스크감독 방향 및 과제를 제시하였다. 특히 국제적 감독수준 측면에서 볼 때 정보공시 및 투자교육, 설명 및 보고의무 등과 같은 항목은 매우 미비한 것으로 나타나 중장기적 측면뿐만 아니라 단기적 측면에서도 감독수준의 강화가 요구된다.

영문 초록

Risk-Based Supervision(RBS) is an essential element for the successful development of private pension system and the protection of members` interests. Supervisory system of developed countries tends to manage and control based on supervisory phases comprised of suitability, monitoring, communication, measure and analysis, and intervention and correction. To the contrary, Korea lacks effective supervision and specific risk based regulatory framework. Based on the analysis of RBS of developed countries, this paper attempts to identify problems and issues as to fiduciaries` risk associated with recently introduced Korean private pension system and suggest RBS framework in the long run. From the international perspective, more emphasis needs to made on disclosure of information, education of members of the pension plan, and reporting requirements.
