국문 초록

2000년대 들어 우리는 강원도 태백시 사례, 성남시 모라토리움 선언 사례 등을 통하여 지방재정 건전성이 미치는 영향이 결코 적지 아니한 점을 경험하였다. 지방재정위기관리제도는 지방자치단체가 효율적으로 지방재정을 관리하고 운영하도록 예산의 편성 및 집행 과정 전반에서 이루어지는 ｢지방재정법｣ 규정상의 각종 제도들을 의미한다. 그리고 지방재정건전성 제고를 위하여 현행 지방재정위기관리제도의 특징과 개선점을 살펴볼 필요가 있다. 먼저 현행법상 지방재정위기관리의 법적 개념이 명확하지 아니한 점은 법치행정 및 행정의 적법성 통제 측면에서 개선되어야 할 사항이다. 그리고 재정위기관리의 측면은 사전적인 측면과 사후적인 측면이 있는데, 현행 지방재정위기관리제도는 사후관리에 보다 초점이 맞춰져 있는 점 역시 지방재정을 미리 건전하게 관리하는데 걸림돌이 된다. 그러므로 지방재정위기를 초래하는 지표를 추가적으로 연구하고 관리함으로써 지방재정위기를 사전적으로 관리하는 방안을 마련해야 할 것이다. 뿐만아니라 현행 지방재정위기관리제도는 지방자치에 정부가 관여하는 형태로 지방자치단체의 자율성을 제한하므로 그 한계 및 관여의 방법에 있어 지방자치를 존중하는 형태로 개선될 필요가 있다.

영문 초록

In the 2000s, we experienced that the impact of local financial soundness was not small through the case of Taebaek－si, Gangwon－do, and the case of the Moratorium declaration in Seongnam－si. The local financial crisis management system refers to various systems under the provisions of the Local Finance Act, which are carried out throughout the budget compilation and execution process so that local governments can efficiently manage and operate local finances. In order to improve local fiscal soundness, it is necessary to examine the characteristics and improvements of the current local fiscal crisis management system. First of all, the fact that the legal concept of local financial crisis management is not clear under the current law is a matter to be improved in terms of the rule of law administration and the legality control of administration. In addition, the aspect of fiscal crisis management has both preliminary and post－mortem aspects, and the fact that the current local financial crisis management system focuses more on post－management also hinders the sound management of local finances in advance. Therefore, it is necessary to prepare a plan to proactively manage local fiscal crises by additionally researching and managing indicators that cause local fiscal crises. In addition, the current local financial crisis management system limits the autonomy of local governments in the form of government involvement in local autonomy, so it needs to be improved in the form of respecting local autonomy in its limitations and methods of involvement.
