국문 초록

이 논문은 EU 예산의 부정 지출 통제 체제를 법적·제도적 변화의 관점에서 분석하고 효율성 강화방안을 논의한다. 2020년 EU 예산은 27개 EU 회원국 국내총생산(GDP)의 1% 정도를 차지한다. 그러나 회원국별로 순기여국과 순혜택국 간의 이해관계가 종종 충돌해 왔다. 2021-2027년 간 EU 예산은 사상 최초로 2조 유로를 돌파한 대규모이기 때문에 부정 지출 방지는 EU에게 더욱더 중요하다. 유럽검찰청(EPPO)이 출범하기 전 EU 예산의 사기 방지를 감독하고 통제하는 기구는 유럽반부패국(OLAF)과 유로저스트(Eurojust), 유로폴(Europol) 등의 세 기구이다. 그러나 세 기구 모두 기소권이 없다. 반면에 2020년 출범한 EPPO는 기소와 수사권을 보유한다. 아울러 1990년대 말부터 회원국 간의 단일한 형사법전(corpus juris)도 점차 제정되었다. 유럽사법재판소는 최근에 법치주의 준수와 EU예산 지원 연계가 합법적이라는 판결을 내렸다. 따라서 EPPO의 출범과 이 판결이 상호작용해 EU예산의 부정 지출 통제 시스템이 더 효과적으로 작동할 가능성이 높아졌다.

영문 초록

This paper aims at analyzing the control system of European Union (EU) budget from the perspectives of legal and institutional changes and discussing its effectiveness. The budget amounts to around 1% of the Gross Domestic Product of the 27 Member States of the EU in 2020. But there have been frequent conflicts between the net beneficiaries and contributors. Controlling its proper use is all the more important in that the budget exceeds ？？2 trillion for the first time from 2021 to 2027. Prior to the establishment of the European Public Prosecutor’s Office (EPPO), three institutions – European anti-fraud office (OLAF), Eurojust and Europol – addressed the budget control. Yet, all three had no right to prosecute. On the other hand, EPPO has both investigating and prosecuting rights from its operation in 2020. Along with the EPPO, there has been gradual coming into force of corpus juris, a single code of penal laws applicable across the Member States. The European Court of Justice recently judged linking the EU funding with the observance of Rule of Law (Rule of Law Conditionality) legal. The EPPO and the conditionality would be more likely to enhance the budget control.
