감정평가 검토 관련 제도 고찰 및 선결과제

국문 초록

본 연구는 국내 감정평가 검토 관련 제도와 미국의 감정평가 검토제도 운용실태를 바탕으로 양국 제도 간의 차이를 비교하고 향후 감정평가 신뢰성 향상을 위한 추진 방향과 선결과제를 제시하는 것에 목적이 있다. 본 연구에서는 국내 감정평가 검토 관련 제도의 유형을 감정평가 사전심사제도와 감정평가 사후조사·검토제도로 구분하여 관계 정립 방안을 제언하고, 감정평가 신뢰성 향상을 위한 검토제도 추진 방향 설정 측면에서 감정평가 검토제도 도입을 위한 선결과제를 제언하였다. 감정평가 검토제도 도입을 위한 선결과제로는 ⅰ) 국내 감정평가 검토제도 도입의 사회적 합의 도출, ⅱ) 감정평가 검토의 법적 근거 마련 및 심사제도 등 연계방안 모색, ⅲ) 감정평가 검토업무 수행 관련 기준 마련, ⅳ) 감정평가 검토제도 도입을 위한 보수체계 개선 등을 제언하였다. 최근 감정평가산업의 환경변화 등에 따라 감정평가 검토제도 도입 논의가 이루어지고 있으나, 국내에서 감정평가 검토와 유사한 제도가 시행되고 있는 만큼 각 제도 간의 관계 정립이 모호할 뿐만 아니라 미비점 등 여러 논란이 있는 상태이다. 따라서 기본적으로 제도 도입에 따른 예상 기대효과 및 부작용 등을 신중하게 고려하여 향후 추진 방향을 설정해야 할 것이다.

영문 초록

This study compares the differences between the domestic and the U.S. appraisal review system based on the operation status of the two countries systems. Moreover, this study aims to present directions and prior tasks to improve the reliability of appraisal in the future. The system types related to domestic appraisal review are divided into an appraisal prescreening system and an appraisal postinvestigation and review system. Moreover, this study proposes a plan to establish their relationship. Further, it suggests prior tasks for introducing an appraisal review system in terms of setting its direction to improve the reliability of appraisal. The following are the prior tasks for the introduction of an appraisal review system in Korea: (ⅰ) reaching a social consensus ; (ⅱ) preparing the legal basis and establishing a plan to link the screening system; (ⅲ) preparing the standards for the performance of appraisal review; and (ⅳ) improving the fee system. Recently, there have been discussions on introducing an appraisal review system in line with environmental changes in the appraisal industry. However, the relationship between similar systems being implemented in Korea is ambiguous, and various issues emerge. Therefore, the direction of future implementation should be established by carefully considering the expected and side effects of the introduction of the appraisal review system.
