사립학교법 개정 논의의 주요쟁점과 과제

국문 초록

본 연구는 사립학교법 개정 논의의 주요 쟁점에 해당되는 핵심적인 내용을 교육의 자주성과 공공성을 바탕으로 분석하고 논의하려 사도되었다. 이를 위해 문헌분석적 접근을 주요 연구방법으로 하여 사학의 특성으로서 특수성, 자주성, 공공성 등을 고찰하고, 현행 사립학교법의 핵심적인 내용 개정 당시 찬성·반대 논리와 시각을 정리한 후, 최근의 재개정 요구 추세를 분석하고 주요쟁점에 관해 논의하고 있다. 특히 사학의 투명성과 공공성 확보 차원에서 도입된 개방이사제도가 논쟁의 핵심에 자리 잡고 있다. 현행 사립학교법 시행에 따른 지속적인 갈등을 원만히 해결하기 위해서는 공교육의 질 개선에 관심을 두고 교육의 공공성과 자율성이 조화를 이루는 접점을 찾아야 할 것이며, 사학 육성·지원의 시각에서 사학관련법규 체제의 정비도 뒤따라야 한다.

영문 초록

The purpose of this study is to consider over the main issues implied in the private school law, with relating to the autonomy and the publicity of education. by examining some research papers and representative reported materials on the law. For achieving this purpose the autonomy and publicity of private school were studied at first, and the main standpoints for and against the law were examined. The main result and findings of this study can be summarized as follows. 1) The independent director system of the board of directors for obtaining the clarifying and publicity of the private school locates on the heart of the main issues implied in the revised private school law. 2) The reinforcement of the publicity of education leads to the weakened autonomy of private school. 3) It should be the desirable direction that the publicity harmonizes with the autonomy to seek for the point of contact by concerning with raising the quality of public education. 4) The conception of the publicity and of the autonomy should be recognized as a good match in education from the standpoint of interacting mutually. 5) In the viewpoint of supporting private schools, further examinations on the systematic structure of the law and regulations related to the private school should be required.
