국문 초록

本稿では，日本における財政政策の一端を示したうえで，会計検査や監査を含めた財 政統制について概観する。その際，適宜，フランス法を比較参照することにしたい。こ れは，筆者がこれまで日本法とフランス法の比較をもとにした研究をしてきたことによ るところが大きいが，沿革的にみても，フランス法がドイツ法とともに，日本の財政制 度の基礎を形成してきたという経緯があったことによる。 また，財政政策と財政統制という2つのテーマのうち，本稿では，財政統制を重点的 に扱い，財政政策については，財政均衡に関する諸問題を中心に，財政政策に対する実 体的な規律の論点をいくつか取り上げるにとどめることにしたい 1) 。 以下では，はじめに日本の財政法の概観をしたのちに (Ⅰ)，財政政策とその法的規律 について簡単に述べる (Ⅱ)。これらをもとに，本論というべき，日本における財政統制 の諸形態について述べることになるが，便宜上，会計検査と監査に関する制度的な諸問 題 (Ⅲ) と裁判的統制をはじめとした理論的な問題 (Ⅳ) に分けて述べることにしたい。

영문 초록

This thesis is intended to analyze the Japanese public finance from the legal viewpoint, referring to French law as appropriate, since France is the country of origin for the Japanese Public Accounting Law in the Meiji era, and in consequence for the existing Public Finance Law. Regarding the order of topics, the legal framework of public finance is briefly examined at first, such as the Golden Rule, which means that the Government may borrow only to invest and not to fund current spending, and the multiple year-based management of budget. Secondly, various institutional problems concerning accounting systems and audits are presented, in targeting principally the legislative reform of local public finance in 2017. Lastly, some theoretical problems are stated, such as the judicial control of public finance (including liability of accounting officials) and the principle of true and fair view, as a new budgetary principle.
