국가발전을 위한 신재생에너지 정책의 바람직한 방향모색

국문 초록

본고는 신재생에너지법의 연혁과 주요내용에 대해서 간단히 살펴보고 이에 대한 문제점과 개선방안을 제시하는 것을 목적으로 하고 있다. 현행법제는 아주 간략하게 묘사하면 국가(산자부장관)가 기본적인 계획을 세우고 이 계획을 바탕으로 공공기관을 중심으로 기술개발, 이용 및 보급을 도모하고 있으며 민간영역에 대해서는 손을 드는 자에게 지원을 하는 구조로 되어 있다. 구조가 단순한 만큼 작동이 용이하겠지만 신재생에너지를 둘러싼 문제들은 이처럼 단순한 구조로 포섭하기에는 너무나 복잡하고 중층적이다. 물론 이처럼 단순한 구조를 추구하게 된 데에는 충분한 이유가 있다. 그 중 가장 큰 이유는 신재생에너지의 경제성이 낮다는 점이다. 그렇기 때문에 자발적으로 시장이 형성되기 어렵고 결국 국가가 예산을 투입하여 공공기관을 중심으로 정책을 펼칠 수밖에 없었다. 그러나 상황은 변하고 있다. 현재 신재생에너지정책을 펼치는데 있어서 가장 문제가 되는 것이 경제성문제인데 이 점에 대해서도 정부는 2020년경에는 대부분의 신재생에너지의 경제성이 확보될 것이라는 전망을 이미 내놓은 적이 있다. 이렇게 볼 때 신재생 사업이 중요한 산업으로 자리 매김할 것이라는 점에 대해서는 누구나 동의하리라 생각한다. 따라서 육성 위주의 매우 단순한 구조로 되어 있는 현행 신재생에너지법은 여기에 규제의 틀도 더하여 주변의 상황변화를 충분히 포섭할 수 있는 새로운 시각에서 좀 더 체계적인 내용으로 개편할 필요성이 있다. 이와 같은 관점에서 볼 때 현행법제가 가지고 있는 주된 문제점으로 다음과 같은 점을 들 수 있다. 즉, ①환경, ②성과공유, ③지방분권, ④시민참가, ⑤규제의 틀, ⑥행정조직의 협조체계구축 그리고 ⑦국제적 시점 등이 그것이다. 개선방안 역시 위와 같은 점을 중심으로 제시되어야 할 것이다.

영문 초록

This paper looks into the history and the contents of Korean New Renewable Energy Law and suggests some solutions to solve the problems concerned. The main prescription of the existing law is that at first the government makes the basic plan and then public organizations are generally engaged in developing technology, making use of and supplying it. In private area the law subsides only the volunteering enterprisers. It can be said that if anything it works well because of its simple structure. But it is not sufficient to meet the complicate problems around the new renewal energy policy. But, of course, they have good reasons to keep the simple structure. The main one is that the economic feasibility of new renewal energy is low. And so the market for it is difficult to develop voluntarily and the government is forced to spend the national budget and make the public organizations engage in. But the business situation has been changed greatly. As mentioned above, one of the biggest problems concerned about is the economic feasibility. But the government has already forecast that the problem will be solved around 2020. Then new renewal energy industry might well be regarded as an important one. And so the new renewal law characterized as supply sided will be reformed to meet the changing business situation. From the aspect mentioned above, those problems concerned about the existing law system is as follows; ①on environment, ②sharing the business earning, ③local autonomy, ④participation of citizens, ⑤regulatory system, ⑥adjustment of administrative organization and ⑦international perspective, etc.. And so the solutions should be considered according to them.
