성구매의도에 영향을 미치는 요인

국문 초록

‘성매매방지법’이 시행되고 성매매에 관련된 각종 정책이 실행되는 상황에서도 성매매 처벌의 억제효과에 대한 실증적 연구는 많지 않다. 본 연구는 고전주의적 억제이론에서 발전한 확대된 억제이론에 근거하여 성매매에 있어 처벌의 공식ㆍ비공식 억제효과에 대한 실증적인 검증을 시도하였다. 처벌의 확실성, 성매매 규제에 관한 인식, 과거 처벌경험, 비공식 억제 그리고 성매매의 주된 요인이라고 볼 수 있는 성매매에 대한 호의적 인식을 주요 요인으로 법무부와 한국형사정책연구원에 의해 시행된 성구매사범을 대상으로 하는 설문 자료를 분석하여 실증적으로 진단하였다. 분석결과에 의하면, 처벌의 확실성과 비공식 억제요인이 성구매의도에 영향을 미쳤다. 특히 상징적 문화요소로써 성구매에 대한 호의적 인식이 가장 큰 영향을 미치는 것으로 나타났다. 이를 통해 성매매에 있어 처벌의 공식ㆍ비공식 억제 효과가 작용한다는 사실을 확인 할 수 있었으며 우리사회 저변문화에 깔린 성매매에 대한 호의성이 매우 중요한 요인임을 발견할 수 있었다. 이러한 분석결과를 토대로 성매매를 줄이기 위한 정책 방안에 대해 논하였다. 본 연구는 그동안 억제연구의 대상에서 다소 소외되었던 성매매를 화두로 하였다는 점과 성매매의 특수성을 감안하여 문화적 호의성을 요인으로 고려하였다는 점에서 기존연구와 차별되는 기여가 있을 것으로 기대된다.

영문 초록

Despite numerous efforts of criminal justice system for banning prostitution, buying sex among men has alleged to be increasing in South Korea. It is important to investigate empirically the effect of criminal justice and community based efforts on prostitution. The purpose of this study is to examine whether the criminal justice based punishment and the community based shaming deter the intention to purchase sexual services. In addition, This study also intends to consider the effect of male dominated symbolic culture of pro-prostitution attitudes. That is, this study tested how formal and informal deterrence efforts as well as pro-prostitution attitudes affect the intention for paying for sex among prostitution consumers. The data used in this study was collected from 509 Koreans who have prior experience with prostitution. The results indicated that formal and informal deterrence efforts could help reduce the intention for buying sexual services. It also appears that the cultural favor to or tolerance for prostitution plays an important role for their intentions to go to prostitutes. The results were discussed and implications for further research and policies were suggested.
