국문 초록

급속하게 고령화되어가고 있는 우리 사회는 노인문제와 관련하여 다양한 도전에 직면하고 있다. 특히 과거 가족공동체에게 맡겨졌던 노인부양의 의무를 사회복지체계가 담당하면서, 노인에 대한 경제적 지원은 향상되었지만, 정서적 소외감은 심화되고 있는 상황은 앞으로의 노인복지 정책이 고려해야할 중요한 문제이다. 노인의 정서적 소외를 해결을 위해서는 가족공동체의 회복이 시급하지만, 오늘날 전통적 가족윤리를 복원하는 것은 정당화되기 어렵다. 따라서 개인의 자유의 확대를 추구하는 현대사회에서 부모에 대한 자녀의 의무는 새로운 윤리적 근거에 따라 정당화하지 않으면 안 된다. 본 논문은 부모에 대한 자녀의 의무를 정당화하는 다양한 이론을 호혜성에 근거한 이론과 특별한 관계에 근거한 이론으로 나누어 검토하여 그 한계를 지적하고, 칸트의 자선의 의무가 자녀의 의무를 정당화하기에 적합하다는 점을 밝힌다. 칸트의 자선의 의무는 인간에 대한 보편적 의무를 위반하지 않으면서도 부모와 자녀의 특별한 관계에서 비롯하는 특별한 의무를 정당화할 수 있다. 이것은 자선의 의무가 넓고 불완전한 의무이고, 넓고 불완전한 의무는 특별한 개인적 관계와 사회적 맥락 안에서 완전한 의무가 된다는 것을 통해 밝혀진다.

영문 초록

Because of a rapidly growing elderly population, our society is facing a variety of challenges to caring of elderly people. In particular, as social welfare system undertakes duty of caring elderly people that has been duty of family members in past, instead of the increased economical supporting, elderly people's emotional sense of isolation is deepening. Therefore emotional supporting for elderly people is critical challenge to the aged welfare policy. For resolving the problem of emotional alienation of elderly people restoring of family as ethical community is urgent, but traditional family ethics is outdated nowadays. Therefore, in present society, it is necessary to justify the filial obligation to elderly parents on new ethical foundation. This paper is researching various theories that are justifying filial obligation and criticizing the limits of the theories that justify filial obligation on special emotion (such as friendship or filial love) and special good between parents and adult children. Instead, this paper examines Kant's duty of beneficence suggesting that at its core, performance of filial duty occurs in response to the needs of elderly parents. The needs of parents make imperfect duty of beneficence to perfect duty because of special relationship between parents and adult children.
