‘국가조찬기도회’의 헌법적 문제

국문 초록

본래 종교단체에서 실시하는 기도회는 종교행사로서 이에 누가 참여하는지나 어떠한 내용으로 하는지는 원칙적으로 종교의 자유의 문제에 속하고 정교분리의 원칙 위반의 문제도 등장하지 않는다. 그러나 1968년부터 실시되고 있는 국가조찬기도회는 기독교단체인 사단법인 대한민국국가조찬기도회가 주관하여 실시하는 것임에도 불구하고 그것이 정교분리의 원칙에 위반되는 것이 아닌가 하는 의문이 제기된다. 그 근거로는 이 기도회가 본래 독재시기에 대통령을 위한 기도회로 출발하여 정치권력을 종교가 정당화하는 역할을 수행하였을 뿐 아니라 현재는 종교단체가 국가권력에 자신의 영향력을 행사하는 통로로 자리잡고 있다는 점, 국가의 고위공직자들이 기도회에 개인적으로가 아니라 공적 지위를 내세우면서 참석하고 있으며, 전체 절차 가운데 중요 부분을 담당하고 있다는 점, 대통령의 입장 행사와 대통령을 위한 기도 등 특정 공직자를 위한 기도회로 기획되어 있다는 점 등에서 정교분리의 원칙에 위반된다고 볼 여지가 많다. 헌법과 국가공무원법에서 종교의 자유, 정교분리의 원칙, 종교중립의무 등을 구정하고 있으나, 아직 세부적인 행동의 기준은 정립된 상태가 아니라는 점이 국가와 종교 사이의 관계를 설정하는 데 장애가 되고 있다. 이에 이 논문에서는 미국 연방정부의 종교의 자유 및 종교적 표현에 관한 가이드라인을 원용하여 공무원의 행위에 관한 지침을 제정할 것을 권고하고 있다.

영문 초록

Any person, including the President, has the right of religious freedom. He or she can freely participate in a religious service or pray in his or her religious belief. Art. 20 of the Korean Constitution provides freedom of religion and the separation of religion from politics and state. This Article can be interpreted as the guarantee of the freedom of religion, prohibition of religious compulsion to believe, not to believe or convert, etc. The establishment of state religion shall be prohibited. The meaning of this Article can be said to have the same meaning as the First Amendment of the U. S. Constitution, but this fundamental right has not had normative force until recently. There are many cases related to the religious freedom and the separation of state and religion. This thesis is a constitutional study regarding constitutionality of the National Prayer Breakfast in Korea. Historically, the Prayer Breakfast began for the purpose of justification or mystification of dictator President Park. The conservative Christian group sponsored the dictatorial regime during his reign. It was the excessive entanglement between state and religion. Though the character of the Prayer Breakfast changed a lot after the democratization in 1980s, it reveals the unconstitutionality in its form and its participants. Even though the Prayer Breakfast is sponsored by the National Prayer Breakfast, not by the state, the President participates in the Prayer Breakfast as a President of Korea. Though he has no religious purpose to sponsor a particular religion, it has the religious effect, because he addresses in public in religious words.
