국제결혼 다문화 이주여성의 인권 보호 방안

국문 초록

한국사회는 1990년대 이후 청년층 남녀 성비의 불균형, 농촌과 도시간의 사회문화적 격차, 저출산 등 농촌 인구문제의 심각성으로 인한 비정상적 국제결혼이 증가해 왔다. 인구감소의 위기 속에서 연간 결혼의 10%이상을 차지하는 국제결 혼을 받아들이고 있으면서도 아직 외국인을 포용하는 사회제도 와 국민의식은 아직 준비되어 있지 못한 것이 현실이다. 2000년대 초반 국제결혼의 양적증가 및 결혼중개업에 대한 방치로 여성인권의 문제가지속적으로 발생하였다. 이미 많은 연구를 통해 국제결혼이민자 여성들의 성 상품화나 가정폭력에 대한 문제가 제기된바 있다. 먼저 사회문화적 편견에 의한 인권 문제이다. 언어소통 부족으로 겪는 차별 속에 적응이 어려울 수밖에 없으며, 빠른 시일 내에 혼인이 이루어짐으로써 서로의 문화를 이해하기 보다는 한국문화에 적응하고 맞춰 나가길 바라는 갈등 등에서 오는 인권 침해가 있다. 또한, 이주여성의 인권에 영향을 미치는 요소 중의 하나는 바로 국제결혼 중개업체를 통한 국제결혼이다. 이들을 통해 국제결혼을 하는 경우 대부분이 돈을 지불하였는데 이로 인해 여성의 상품화가 심화되는 문제로 이주이후 결혼생활 등에 서 오는 인권 침해가 있다. 향후 국제결혼이 이루어지는 형태가 지금과 같이 유지되거나 인권유린에 대해 적절한 제도적 장치가 마련되지 않는다면, 여전히 다문화 여서의 국제결혼에 있어 인권문제가 중요한 이슈로 남아있게 될 것이다. 따라서 국제결혼 이주여성에 대한 인권침해 해소를 위해서는 법적제도개선을 통한 해소와 사회문화적 해소방안, 사회적 여건개선을 통한 인권보호방안대책을 마련해서 정책적으로 추진해나가야 할 것이다 .

영문 초록

Since 1990's the abnormal international marriages have increased due to unbalance of gender ratios among the young population, widening gap between rural and urban areas, lower birthrate and other problems of the agricultural society. Amid the sense of crisis for decreasing population, the international marriages have accounted for more than 10% every year, but our social systems and peoples' consciousness still have to embrace the foreigners married to Koreans. Since early 2000's, the international marriages began to increase rapidly, while the marriage broker businesses have remained unsupervised. The result has been increasing infringements on foreign women's human rights. Many preceding studies have raised the question that the emigrant women married to Korean men have been victims of sexual commercialization or intra-family violence. Above all, emigrant women's human rights have been infringed upon due to some socio-cultural prejudice. Because of the linguistic problem and the social discrimination combined, foreign women can hardly be adapted to the Korean society. As they marry the Korean men very quickly, the heterogeneous couples can seldom understand each other's culture. In short, foreign women are forced to adapt themselves to the Korean culture, causing various conflicts and having their human rights infringed upon. In addition, one of the factors affecting their human rights is the fact that they have married Korean men through agency of the international marriage broker businesses. When they are introduced to Korean men, most of them pay some money for the brokerage, which serves to commercialize women and cause the marital conflicts later. If the paths for the international marriages remain unchanged or if a proper mechanism should not be arranged to protect foreign women's human rights, infringement upon their human right will remain a serious social issue. Accordingly, in order to remedy infringements upon emigrant women's human rights, it is necessary to rearrange the legal systems, improve our socio-cultural environment and social conditions and thereby, solve the problems with effective policies.
