국문 초록

정부가 새로운 규제를 신설하거나 규제를 완화한다는 의미는 규제의 합리적 수준을 정책에 반영함으로써 행정서비스 영역에서 국민에 대한 편의성을 질적으로 개선하고 경제영역에서 발전적 토대의 형성과 경쟁력을 향상해 나가기 위함이다. 국가는 합리적 규제의 적정수준을 결정하여 규제에 따르는 비용과 편익에 있어서 비용보다 편익이 커지도록 정책을 형성해 나가야 한다. 정책결정권자인 입법권자는 정책의 유형에 따라 어떠한 범위와 내용으로 규제를 형성할지 폭넓은 형성의 자유를 가지게 된다. 정책의 경쟁력 강화를 위해서는 합리적 규제의 수준을 정책 및 입법의 영역으로 수렴하여 적정 규제개선을 통하여 국민생활의 질적 개선과 경제발전을 위한 합리적 규제환경을 조성해 나가야 할 것이다. 정책이 입법으로 완결되는 만큼 입법과정에서 체계적 규제심사와 합리적 규제기준의 적용이 요구된다. 본 논문에서는 우리의 정책형성 및 입법과정에서 적용되어온 사전적 규제심사제도 및 규제심판제도의 한계요인과 해외 국가의 규제영향평가제도의 장단점을 분석하여 우리 한국에 적용가능한 해외 국가의 규제영향평가제도의 장점에 근거한 합리적 규제의 심사체계와 기준을 구축하기 위한 대안을 제시하고자 한다.

영문 초록

The reason why the government creates new regulation or eases regulation is to qualitatively improve the convenience of the people in the field of administrative service and to improve the formation of a developmental foundation and competitiveness in the economic field by reflecting the reasonable level of regulation in the policy. In the case of overregulation, it causes inconvenience to people's lives or hinders the autonomy of economic activities, leading to economic recession. The state should determine the appropriate level of rational regulation and form policies to ensure that the cost and benefit of regulation outweigh the cost. Legislator, who are policy maker, have a wide range of freedom to form regulation according to the type of policy. As the policy is completed by legislation, systematic regulatory review and application of rational regulatory standard are required in the legislative process. This paper identifies the limitations of the pre-regulatory review and regulatory review system applied in Korea's policy-making and legislative processes, analyzes the strengths and weaknesses of foreign regulatory impact assessment system, and proposes regulatory impact assessment standard applicable to Korea and alternative for reasonable regulatory review.
