교육배려계층 지원 법제도 분석과 개선방안

국문 초록

본 연구는 교육배려계층의 교육권 보장을 위한 현행 법·제도를 종합적으로 평가하고 개선 방안을 제시하였다. 주요 교육 관련 법령(교육기본법, 평생교육법, 장애인 등에 대한 특수교육법, 다문화가족지원법, 한부모가족지원법, 디지털포용법 등)을 대상으로, 체계성(법체계의 일관성과 권리 강제성), 충분성(지원 내용의 포괄성과 적합성), 효율성(전달체계의 통합성과 책임성), 안정성(재정 지원의 지속성과 예산 확보)을 기준으로 분석하였다. 분석 결과, 교육배려계층 지원 법제도는 헌법-교육기본법-개별법 간 개념과 책무 규정의 연계가 미흡하고, 경제적 지원 위주로 정서·문화적 측면이 미진하여 충분성이 제한적이었다. 또한 중앙정부와 지방정부간 역할 분담 측면에서 협력이 다소 부족해 효율성이 저해되고 있었으며, 재원의 안정성 또한 취약한 것으로 나타났다. 이러한 한계를 개선하기 위해, 교육복지 관련 법률의 통합적 체계 정비(예컨대 교육복지 기본법 제정 또는 범부처 협의체 구축), 수요자 맞춤형 지원 내용 확대(심리·사회적 지원 및 디지털 역량 강화 포함), 원스톱 전달체계 구축과 책임 주체 명확화, 예산 확보 명확화 및 성과 환류 장치 마련이 필요할 것으로 보인다.

영문 초록

This study analyzes the current laws and institutions supporting these groups through a public administration lens and proposes improvements. The analysis indicates that the support system for educationally disadvantaged groups lacks legal coherence across the Constitution, framework law, and special laws, undermining the structural foundation of rights. Support provisions are largely financial and do not sufficiently cover psychosocial, cultural, or digital needs, limiting adequacy. Roles of central government, local authorities, and schools are ambiguously defined with insufficient coordination, reducing efficiency in policy delivery. Moreover, much of the support depends on non-mandatory funding, leading to weak stability in financing.This study recommends an integrated legal framework for educational welfare, expansion of support services to meet diverse learner needs, establishment a clear accountability, and securing mandatory budgets and feedback mechanisms to ensure financial sustainability.
