대학에서 교양 법학 교육의 개선 방안에 관한 연구

국문 초록

우리나라에 로스쿨 제도가 도입된 이후 대학에서 교양 법학 교육이 축소되면서, 대학생들의 법적 소양과 민주적 역량 함양이 위협받고 있다. 본 연구에서는 이러한 문제 인식 하에 교양 법학 교육의 기능을 재조명하고 개선 방안을 모색하기 위해 ‘미국, 영국, 독일, 일본’ 등 주요국의 교양 법학 교육 사례를 비교 분석하여 시사점을 도출하였다. 연구 결과, 교양 법학 교육은 단순한 법 지식 전달을 넘어 ‘리걸 마인드’ 함양이 중요하며, 디지털 기술을 활용한 참여형 교육, 인접 학문들과 접근을 통한 융합형 교육, 학생 특성에 따른 차별화된 교육이 필요함을 확인하였다. 결론적으로 교양 법학 교육은 민주 시민 역량 강화에 핵심적인 요소로 ‘교육 목표 재정립, 혁신적 교육 방법 도입, 디지털 기술 활용, 융합형 교육 추진, 학생 맞춤형 교육 제공, 교수자 지원 강화, 질 관리 시스템 구축을 통한 지속 가능한 교육 기반 마련’ 등을 개선 방안으로 제안하였다.

영문 초록

Since the introduction of the law school system in Korea, legal education has been reduced as a liberal arts course in universities, which threatens the development of legal literacy and democratic competence among university students. In order to reexamine the function of legal education as a liberal arts and seek ways to improve it, this study draws implications from a comparative analysis of legal education as a liberal arts in major countries such as the United States, the United Kingdom, Germany, and Japan. The results of the study confirmed that legal education as a liberal arts requires not only the transmission of legal knowledge, but also the cultivation of a ‘Legal Mind’, participatory education using digital technology, convergent education through access to adjacent disciplines, and differentiated education according to student characteristics. In conclusion, as a liberal arts, legal education is a key factor in strengthening the capacity of democratic citizens, and the report suggests the following as improvement measures: redefining educational goals, introducing innovative teaching methods, utilizing digital technology, promoting convergent education, providing customized education for students, strengthening instructor support, and establishing a sustainable education foundation by establishing a quality management system.
