국문 초록

현재 우리나라 지적측량 관련 법 규정은 ｢공간정보의 구축 및 관리 등에 관한 법률｣과 ｢지적측량 시행규칙｣ 외 각종 규정으로 구성되어 있어 지적측량 실시기준과 절차, 경계설정, 면적측정 등에 대한 수행방법이 분리되어 있다. 이로 인해 법 규정들끼리 실시기준과 절차가 중복되고 과거 지적법의 내용을 토대로 발전됨에 따라 시대적･환경적인 변화를 반영하지 못한 문제가 발생하고 있다. 이에 본 연구에서는 지적측량 관련 법 규정의 해석과 적용에 혼란이 발생하는 문제에 대해 초점을 두어 과거 법 규정과 현재 법 규정이 시대에 맞게 개정되었는지 분석하고 지적측량성과 심사자와 지적측량 수행자를 중심으로 설문을 수행하여 법 규정의 적합성을 분석하였다. 그 결과 측량 장비, 측량 방법, 한자어의 사용 등의 문제를 도출하였으며, 사용자 측면에서 지적측량 관련 법 규정을 적용하기 편리할 수 있도록 개선방안을 제시하였다.

영문 초록

The current legal system related to cadastral survey in Korea consists of various regulations other than ｢Act on the Establishment, Management, etc. of Spatial Data｣ and ｢Enforcement Rule of Cadastral Survey｣. As a result, implementation standards and procedures are overlapped across the legal systems. Due to such issue, as the contents of the past cadastral laws are developed, problems that does not reflect the changes in time and environment rises. Therefore, this study focuses on the problem that causes confusion in the interpretation and application of cadastral survey related to laws and regulations. In order to determine whether the difference between the past and current laws and regulations have been revised according to timly manner, and a questionnaire was conducted mainly to analyze the suitability of legal systems. Consequently, problems such as surveying equipment, surveying methods, and the use of Chinese characters were found, and improvement measures were suggested in order to apply the laws and regulations related to cadastral survey from the user perspective.
