광역자치단체의 발달장애인 권리보장 및 지원에 관한 조례 분석

국문 초록

본 연구는 광역자치단체의 발달장애인 권리보장 및 지원에 관한 조례를 분석하여 그내용과 특징을 확인하고, 여기서 발견되는 문제점을 밝힌 후 개선과제를 제시하고자 하는 목적에서 수행되었다. 2018년 3월 31일 현재까지 제정된 14개 광역자치단체의 발달장애인 권리보장 및 지원에 관한 조례를 대상으로 조례의 명칭, 목적, 지방자치단체장 및시민의 책무, 기본계획의 수립 및 시행, 지원사업, 발달장애인지원위원회 설치 및 운영, 발달장애인지원센터 설치 및 운영, 협력체계 구축, 광역자치단체 조례에서의 특이점을중심으로 분석하였다. 분석결과, 17개 광역자치단체 중 14개 광역자치단체에서 발달장애인 권리보장 및 지원에 관한 조례를 제정하고 있었으며, 상위법인 「발달장애인 권리보장 및 지원에 관한법률」에서 규정하고 있는 사항들이 광역자치단체 조례에서는 일부만 반영되어 규정되어있는 경우가 다수 발견되었다. 특히 조례에서 핵심이라고 할 수 있는 지방자치단체장의 책무, 지원사업, 발달장애인지원센터 설치 및 운영 등에서 이러한 점이 두드러지게 발견되었다. 또한 예산지원과 관련하여 이를 조례상 명확히 제시하고 있는 광역자치단체는 극히 일부였다는 것도 발견되었다. 위의 분석결과를 바탕으로 지방자치단체의 발달장애인 권리보장 및 지원에 관한 조례에 대한 제언을 제시하였다.

영문 초록

The purpose of this study was to analyze the ‘Local Ordinance on Guarantee of Rights and Support for the Persons with Developmental Disabilities’ of regional local governments, to identify their contents and characteristics, to identify the problems found here, and to suggest improvement tasks. As of 31 March, 2018, the 14 regional local governments enacted the ‘Local Ordinance on Guarantee of Rights and Support for the Persons with Developmental Disabilities’, establishing and enforcing the name and purpose of the ordinance, the accountabilities of the heads of local governments and citizens, establish and implement basic plans, support projects, establishment and operation of development support committee for the persons with developmental disabilities, establishment and operation of the support center for the persons with developmental disabilities, establishment of cooperation system, and singularity by local governments. As a result of the analysis, 14 municipalities of 17 municipalities have enacted the ‘Local Ordinance on Guarantee of Rights and Support for the Persons with Developmental Disabilities’, a number of cases were found to be reflected only partially. In particular, this point was remarkably found in the accountability of the heads of local governments, the support projects, and the establishment and operation of the development support center for the persons with developmental disabilities. It was also found that the local governments that clarified these regulations in relation to budget support were only a small part. Based on the results of the above analysis, suggestions for the ‘Local Ordinance on Guarantee of Rights and Support for the Persons with Developmental Disabilities’ of the local government were suggested.
