독도관련 법령의 유형과 특성 연구

국문 초록

본 연구의 목적은 독도관련 법령들이, 언제부터, 어떤 내용으로 제정되어 왔는가를 조사하고, 이를 토대로 관련법령들의 유형과 특성을 제시하며, 어떻게 하면 독도관련 법령들이 독도수호에 기여할 수 있는가에 대한 방향을 제시하는 데 있다. 이상의 연구목적을 위해 조사방법은 문헌조사법과 인터넷조사법을, 분석방법은 기술적 분석방법을 사용하였다. 연구범위로서 시간적 범위는 1982년부터 현재까지로, 공간적 범위는 한국과 일본으로, 내용적 범위는 독도와 관련된 법령으로 한정하였다. 연구결과, 독도관련 법령의 유형은 2005년 이전은 중앙정부가 운영주체인 독도보전형 법령이었으며, 2005년 이후는 지방정부 위주의 독도수호형 법령으로 나타났다. 독도관련 법령의 특성은 일본의 영유권주장에 대한 반작용으로 대부분 급조된 법령으로 나타났다. 따라서 독도관련 법령들이 당면한 문제점을 해결하기 위해서는 독도의 이용ㆍ개발을 통한 실효적 지배보다는 독도수호를 위한 실질적 방안을 규정한 독도법령의 제정을 제언하고자 한다.

영문 초록

The purpose of this study is to how the contents of ordinances relating to Dokdo has been established since 1982, and to present the types and characteristics of those ordinances. In doing so, I will provide the idea how these ordinances relating Dokdo will contribute to the defence of Dokdo. Literature search method, internet search method and descriptive analysis method were used for the above mentioned study. As for the time scope the applied period was from 1982 to the present and the geographical area was limited to Korea and Japan and the contents scope was limited to the ordinances only relating to Dokdo. As a result of this study, it was clarified that the ordinance type relating to Dokdo was a conservation type for Dokdo mainly operated by the central government before 2005. But the ordinance has been changed to Dokdo defence type enacted by the local government since 2005. The characteristic of the ordinances relating to Dokdo clearly shows that most of the ordinances were improvised by the reaction of the Japan which claims its sovereignty. Therefore, this study suggest to establish of the new ordinance for Dokdo which stipulates the substantial plan for defence of Dokdo rather than effective occupation through the utilization and development of Dokdo so as to resolve the current issues.
