국문 초록

이 글은 디지털 대규모 예금 인출을 계기로 촉발되었던 해외 중소형 금융회사의 정리 사례를되짚어 보고, 대한민국의 법ㆍ제도에 의미 있는 시사점을 도출해보고 있다. 미국 중소형 금융회사에속하는 실리콘밸리은행(SVB)의 문제와 정리 사례가 이 글의 중심에 있으며, 동시에 실리콘밸리은행(SVB)의 사태로 부정적인 영향을 받은 영국ㆍ스위스의 정리 사례도 부분적으로 간략히 언급하고있다. 무엇보다도 디지털 금융시스템으로 인한 금융거래의 간편화와 신속화가 시스템 위기로 이어질수 있음을 포착하고 있다. 이러한 점에서 해외 중소형 금융회사의 즉각적이고 신속한 정리에 주목하면서거버넌스, 법적 근거, 정리 방식 등의 특징을 살펴보고 있다. 그리고 대한민국의 적기시정조치 등정리제도를 다시금 파악하며 중소금융회사의 연쇄도산이나 시스템 위기로의 확산 방지를 모색해본다.

영문 초록

This article revisits the resolution cases of overseas small and medium-sized financial institutions triggered by large-scale digital deposit withdrawals, deriving meaningful implications for South Korea's legal system. The problems and resolution of Silicon Valley Bank (SVB) in the United States form the core of this article. It also briefly touches upon the resolution cases in the UK and Switzerland, alongside the negative impact the SVB situation had on small and medium-sized financial institutions in the US. Above all, it recognizes that the simplification and acceleration of financial transactions enabled by digital financial systems can lead to systemic crises. In this regard, it focuses on the immediate and swift resolution of overseas small and medium-sized financial companies, examining characteristics such as governance, legal basis, and resolution methods. Furthermore, it re-evaluates South Korea's resolution system, including timely corrective measures, seeking ways to prevent the spread of chain bankruptcies among small and medium-sized financial companies or systemic crises.
