대한제국의 영토 인식과 영토주권 행사

국문 초록

본 연구는 규장각 소장 「근대정부기록류」의 자료를 활용하여 한국 정부의 영토인식과 영토주권 행사 사례를 수집·정리하는 것을 목적으로 하였다. 그 결과 다음의 내용을 확인하였다. 첫째, 대한제국 수립 이후 국가의 위상 확립과 함께 국경과 영토에 대한 주권 인식이 형성·강화되었다. 둘째, 한국은 영토주권 인식이 강화되는 과정을 거치면서 일본을 비롯한 외국인에 의해 발생하는 주권 침해에 대해 적극적으로 대응하였다. 셋째, 영토주권은 영토에 기반한 이권 수호에도 나타났다. 예컨대 울릉도에 거주하며 벌목과 어업에 종사하는 일본인의 퇴거를 요구하였다. 게다가 일본인에 의해 주로 자행된 불법 채굴과 채석에 대해서도 단속했으며 조선 연안에서 벌어지는 일본 어선의 불법 어업도 금지 조치하였다. 넷째, 한국의 주권행사가 자국의 이익만을 수호하려는 것은 아니었으며 조약에 기반해 합법적으로 행사한 외국인의 권리에 대해서는 철저히 보호했던 것이 확인되었다. 이처럼 대한제국 수립 이후 주권이 미치는 영토 및 이권에 대해서 일본인과 외국인이 벌이는 불법행위는 ‘단속’·‘금지’·‘청구’·‘처벌’ 등으로 영토주권을 행사하고 조약의 이행을 통한 합법적 이권에 대해서는 ‘보호’ 의무라는 영토주권 행사를 병행하였던 것으로 파악된다. 대한제국 수립 이후 강화되기 시작한 한국의 영토인식은 다양한 사례를 통해 점차 더욱더 공고해졌음이 확인되며 영토에 대한 국가 통제 시스템은 조약과 지휘계통에 근거해 능동적으로 작동하고 있었음을 알 수 있다.

영문 초록

This study aimed to collect and organize cases of territorial awareness and the exercise of territorial sovereignty by the Korean government using materials from the “Modern Government Records” housed in the Kyujanggak archives. First, following the establishment of the Korean Empire, the recognition and strengthening of sovereignty over borders and territories were solidified alongside efforts to establish the nation’s status. Second, as Korea’s awareness of territorial sovereignty grew, it actively responded to sovereignty infringements caused by foreigners, including Japan. Third, territorial sovereignty was also evident in the protection of rights based on territory. For example, illegal logging was prohibited, and Japanese residents on Ulleungdo engaged in logging and fishing were asked to leave. Additionally, illegal mining and quarrying— primarily conducted by Japanese individuals—were cracked down upon, and measures were taken to prohibit illegal fishing by Japanese vessels along Korea’s coasts. Fourth, it became evident that Korea’s exercise of sovereignty was not solely for protecting its own interests; it also thoroughly safeguarded the rights of foreigners who acted legally under treaty agreements. Thus, after the establishment of the Korean Empire, illegal activities by Japanese and other foreigners concerning territory and rights were addressed through measures such as “crackdowns,” “prohibitions,” “demands,” and “punishments” as part of exercising territorial sovereignty. Simultaneously, Korea upheld its obligation to “protect” legitimate rights based on treaties. The territorial awareness that began to strengthen following the establishment of the Korean Empire was confirmed to have become increasingly robust through various cases, with a system for national control over territory functioning actively based on treaties and command structures.
