국문 초록

최근 한국에서는 헌법 개정 논의를 하고 있으며, 이에 대한 통치기구 중 대통령의 임기를 중임제로 개정하는 안이 심도 있게 다루어지고 있다. 그리고 헌법학회 등에서는 기본권 중에 새로이 현대에 논의되고 있는 스포츠권, 건강권, 개인정보자기결정권 등에 대해서 새로이 논의하고 있다. 이 중에 스포츠기본권이 현행 헌법개정안에 포함시키느냐에 대한 논의를 중심으로 입법 활동을 하고 있다. 스포츠인의 개념을 정의하기 위하여 기본적으로 검토되어야 하는 것은, 스포츠 선수에 대한 구분인데, 순수하게 건강을 위한 스포츠인과 경쟁을 위한 스포츠선수, 아마추어적 여가선용을 위한 스포츠와 타인에게 보여주기 위한 직업적인 스포츠선수 구분 등이다. 이러한 관점에서 국가와 스포츠단체들은 국민의 대다수가 즐기는 운동과 고도의 능력과 기술이 요구되는 스포츠, 직업스포츠 등을 구분한다. 본 논문에서 논의하고자 하는 스포츠선수는 프로스포츠선수와 아마추어선수가 아닌 장애를 갖고 있는 스포츠선수이다. 그리고 한국에서 스포츠권이 헌법상 인정이 되는 기본권인가 여부를 먼저 다루고, 이러한 스포츠권이 인정된다는 전제하에서 한국과 일본에서 논의하고 있는 장애인의 스포츠 권을 다루고자 한다. 특히 스포츠 활동은 장애인에서 있어 경제적 평등과 행복추구권을 이룩하는 하나의 방법으로서 중요한 의미가 있다. 한국과 일본에서 스포츠권을 장애인이 기본적으로 누려야할 기본권으로서 이해하고 장애인의 스포츠권을 기본권으로서의 인식과 국가적 차원의 집중투자와 육성책이 마련된다면 장애인스포츠는 비약적인 발전을 이룰 수 있는 절호의 기회를 맞이할 것이다. 또한 정부와 국회는 장애인 인권보호와 장애인에 대한 차별을 개선하기 위해 지속적으로 점검하고 정책적 개입을 통한 중재역할을 수행하여야 하며, 장애인 복지행정 전달체계를 강화와 인력 및 예산을 확대에 노력해야 할 것이다. 특히 세부적으로 장애인의 생활에 기본이 되는 接近權, 移動權, 交通權의 보장을 통해 보다 적극적인 관심과 노력을 기울이는 것이 근본적인 해결의 지름길일 것이다.

영문 초록

This research was carried out for the purpose of promoting individual information protection, Sports Players information, individual right to control the circulation of information relating to oneself and Sports Human Right to Disabled People in Korea and Japan. Every Europe country where interests in privacy of individual information is making a law about individual information protection that belongs to enterprise from a business ethics or personal right protection point of view. And enterprise is working out a countermeasure about individual information protection. It is necessary that the sporting rights be admitted as a constitutional right and their sporting rights be also guarantee in an aspect of the dignity of man and value and the pursuit of happiness. But everyone admits that the welfare and sporting facilities for the disabled are necessary at least in rationality, and rejecting to found them in his or her region. The sporting rights in the constitution are thought to be the subject of a bill so that we can help the disabled to get their real rights back. Only in case that they should be included in a subject of a lav of sports promotion, they can take advantage, and organizational efforts should be made for this. Argument is advancing to with depth to the disabled person sport right in Korea and Japan. The efforts which are going to study desire of people and the problem of an obstacle with the obstacle which participates in a gymnastic activity, and are going to improve are required for the future of disabled person gymnastics. By moreover, the individual who leads the right of happiness and equal right which the international result and all human beings pursue, and social participation and who did social integrated and When reflecting synthetically in a disabled person gymnastics policy and its execution the duty of an administration to decide the policy which has on many people etc. at harmony, it will be wishful to achievement of a future vision.
