어린이 놀이시설 안전관리 법규 고찰

국문 초록

법제도적인 측면에서 어린이 놀이시설의 안전한 환경 조성과 안전사고 방지에 도움을 줄 수 있는 기초자료를 제공하기 위하여 어린이 놀이시설 관련 법규 및 ‘어린이놀이시설 안전관리법’을 고찰한 결과는 다음과 같다. 1. 어린이 놀이시설 관련 법규 중 주택건설기준 등에 관한 규정, 아동복지법 시행령, 영유아보육법 시행규칙에서 놀이시설의 설치규모를 직접 규정하고 있었다. 2. 어린이 놀이시설 관련 법규 중 주택법 시행규칙, 아동복지법 시행령과 영유아보육법 시행규칙에서 안전진단과 위생진단, 안전관리규정 등 안전관리 사항이 규정되어 있었다. 3. 어린이 놀이시설의 안전관리를 위한 규정(위생 및 안전점검, 안전기준 등)이 관련법에 산재되어 있고, 다중이용시설 등 일부 시설에 대한 규제법이 없기 때문에 법제도적 기반이 미약한 것으로 분석되었다. 4. 기본법 성격의 어린이놀이시설 안전관리법이 제정되고 시행됨으로써 각 장소별 놀이시설의 관리주체가 명시되었고, 놀이시설의 안전관리 기준과 안전관리 체계의 제도적인 틀이 정비된 것으로 사료된다. 5. 어린이 놀이시설의 안전관리가 확립되기 위해서 놀이시설 설치장소에 따라 다른 소관 중앙행정기관 업무의 일관성 문제, 법적용 경과기간 동안의 안전관리 규제에 대한 문제, 관리주체의 책임의식 등이 해결되어야 할 문제점으로 도출되었고 이에 대한 해결방안으로서 놀이시설의 안전관리를 위한 지방자치단체의 역할 확대 및 관련 조례제정, 관리주체 및 실무담당자에 대한 안전교육 강화, 부모에 대한 안전교육 확대 홍보, 놀이터 안전지킴이 활용 등 시민 관련단체와의 협력체계 구축이 제시되었다.

영문 초록

To supply basic data that can help in safe environment furtherance and accident prevention of child play facilities, result that investigate child play facilities connection legislation and child play facilities safety supervision law is as following. 1. Establishment size of play facilities was prescribed in regulation about Homebuilding standard etc.., Child welfare law enforcement ordinance, Infant nursing law enforcement regulations. 2. Safety supervision item(safety check-up, sanitary inspection, safety level etc.) was specified in Housing act enforcement regulations, Child welfare law enforcement ordinance, Infant nursing law enforcement regulations. 3. Law base was construed by feeble thing because there is no regulation law for some facilities such as multiplex facilities and regulation for safety supervision is scattered about related law. 4. Child play facilities safety supervision law contribute to establish department of play facilities, safety supervision standard of play facilities, systematic frame of safety supervision system. 5. There are problems that is no consistency by other state administration department, relevant department s sense of obligation and safety supervision regulation of inefficacious period in child play facilities safety supervision law. These problems should solve that local government s role extension for play facilities safety supervision, local ordinance enactment, safety education reinforcement about administrator and parents and need cooperation system construction with citizen connection groups.
