소방특별사법경찰제도의 문제점과 개선방안을 통한소방안전관리에 관한 연구

국문 초록

최근 소방범죄는 날로 지능화 및 다양성을 띄고 있으며, 소방기관의 직무도 화재예방과 진압 외에 위급한 상황에서 구조구급활동까지 확대하여 국민의 생명신체 및 재산의 안전을 보호하는 중요한 국가안전관리기관으로 인식되고 있다. 소방특사경은 화재구조 및 구금활동을 통한 국민의 생명신체 및 재산을 보호하기 위하여 소방(화재)사범에 대한 전문성과 신속성이 요구되나 「형사소송법」제195조에서 사법경찰관은 검사의 지휘없이 독자적인 수사권을 행사하고, 경찰과 검사는 상호협력 관계를 인정하고 있으나「사법경찰직무법」제1조는 「형사소송법」제245조의10에서 소방특별사법경찰은 모든 사건에 관하여 검사의 수사지휘를 받으며, 검사와 소방특사경은 상명하복 관계로 수사의 신속성과 전문성이 필요한 소방사건에 대한 독자적인 수사권을 제약하고 있다. 소방공무원의 신분도 국가직으로 전환되고, 소방청으로 승격되었으나 소방업무는 전과 같이 국가직과 지방직으로 이원화되어 운영되고 있으며, 국가공무원과 소방청의 위상에 맞고, 국민의 생명신체 및 재산을 보호하는 최후의 국가안전관리기관이 될 수 있도록 소방특사경 제도의 법상 문제점과 개선방향을 구체적으로 제시하여 명실상부(名實相符)한 소방특사경제도가 정착되도록 하는데 본 논문의 목적이 있다.

영문 초록

Recently, fire-related crimes have become increasingly sophisticated and diverse. Simultaneously, the duties of fire agencies have expanded beyond fire prevention and suppression to include rescue and emergency medical services during critical situations, reinforcing their role as a crucial national safety management institution dedicated to protecting the lives, bodies, and property of citizens. The Fire Special Judicial Police (FSJP) requires both speed and expertise when handling fire-related offenses to safeguard the public effectively. According to Article 195 of the Criminal Procedure Act, judicial police officers can conduct independent investigations without the direct supervision of prosecutors, recognizing a cooperative relationship between police officers and prosecutors. However, Article 1 of the Judicial Police Duties Act, in conjunction with Article 245-10 of the Criminal Procedure Act, mandates that the FSJP must receive prosecutorial supervision for all cases. This hierarchical structure limits the FSJP's independent investigative authority, hindering the speed and specialization required in handling fire-related incidents. Despite the shift of firefighters' status to national public officials and the elevation of the Fire Agency's authority, fire services continue to operate under a dual system of national and local governance. This dual structure creates inconsistencies that do not align with the status of national public officials or the elevated position of the Fire Agency. The purpose of this study is to identify the legal issues within the FSJP system and propose specific improvement strategies to ensure that it functions as a final safeguard of national safety, effectively protecting the lives, bodies, and property of citizens. By doing so, the study aims to establish a fully-fledged FSJP system that aligns with its intended purpose.
