The International Law Discourse on Green Transition Policies: The Case of the European Union

국문 초록

The European Union (EU) has increasingly exhibited a rule-exporting character in its green transition policies, embedding its internal low-carbon standards into the global trade regime through institutional arrangements such as carbon footprint management and the Carbon Border Adjustment Mechanism (CBAM). This approach has strengthened the EU’s discursive dominance in the context of international law, reshaping the power structure of global climate governance while posing challenges to existing WTO rules and to the principle of “common but differentiated responsibilities” under the Paris Agreement. Against this backdrop of regulatory expansion, developing countries face high compliance costs, technical barriers, and constraints on their green transition, further deepening the North-South divide. From China’s perspective, green legislation, carbon market development, participation in multilateral platforms, and “Belt and Road” green cooperation are key pathways to enhance response capacity. Green transition should not evolve into a unilateral tool of technical barriers or regulatory hegemony; instead, the reconstruction of global climate rule of law should be grounded in principles of equity, inclusiveness, and cooperation, fostering sustainable and mutually beneficial ecological governance through institutional coordination.

영문 초록

欧盟在绿色转型政策中日益展现出规则输出型特征，通过碳足迹管理、碳边境调节机制（CBAM）等制度安排，将内部低碳标准嵌入全球贸易规则体系，推动其在国际法语境中的话语主导地位。这一趋势不仅重塑了全球气候治理的权力结构，也对现行WTO 规则、《巴黎协定》所倡导的“共同但有区别的责任”原则构成挑战。在制度扩张背景下，发展中国家面临较高合规成本、技术壁垒及绿色转型受限等问题，南北分化进一步加剧。以中国为分析视角，绿色立法、碳市场建设、多边平台参与及“一带一路”绿色合作被视为提升应对能力的关键路径。绿色转型不应演变为单方技术壁垒或制度霸权工具，全球气候法治的重构应立足于公平、包容与合作的理念，通过制度协调推动生态治理的可持续共赢。
