국문 초록

Driven by technologies such as blockchain, virtual property in the metaverse not only holds greater property value but also features more prominent disposability and circulation. Given that metaverse virtual properties like NFTs already demonstrate rarity, exclusivity, disposability, circulation, and intrinsic property value, they should be included in the category of property as defined by criminal law. By analyzing the distinctions among the legal interests represented by different data layers in the metaverse, it becomes evident that the primary data layer infringed upon when metaverse virtual property is violated is the data symbol layer — i.e., property-related legal interests. Thus, it is both reasonable and necessary to recognize crimes against metaverse virtual property as property crimes. In view of the current lack of effective methods for valuing metaverse virtual property and the deficiencies in metaverse identity verification mechanisms, China should consider incorporating metaverse virtual property into the scope of property protection under criminal law, clarify the standards for valuing virtual property, and promote the continuous improvement of supporting regulatory systems (such as metaverse identity verification mechanisms). These measures will effectively safeguard the healthy development of the metaverse and citizens' property rights.

영문 초록

依托于区块链等技术，元宇宙空间中的虚拟财产不仅具有了更大的财产价值，而且具备了更为显著的可支配性和可流通性。考虑到NFT 等元宇宙虚拟财产已经具有稀缺性、专属性、可支配性、可流通性及财产价值，应当将其纳入刑法规定的财产范畴。结合元宇宙不同数据维度代表法益的差异分析，由于侵犯元宇宙虚拟财产所侵犯的数据维度主要是数据符号层，即财产法益，因此对侵犯元宇宙虚拟财产的犯罪行为有理由也有必要认定为财产犯罪。对于目前元宇宙虚拟财产的价值认定依然缺乏有效的方案、元宇宙身份认证机制不健全等问题，我国应考虑在立法层面将元宇宙虚拟财产纳入刑法财产的保护范畴，明确虚拟财产的价值认定标准并推进元宇宙身份认证等配套管理制度的不断健全，切实保障元宇宙的健康发展以及公民的财产权益。
