국가인권위원회의 「평등법(시안)」에 대한 비판적 검토 - 성소수자 차별금지와 종교의 자유를 중심으로

국문 초록

인권위의 평등법시안은 ‘차별 없는 평등한 사회의 구현’이라는 매우 그럴듯한 목적을 제시하지만 그 내용을 면밀히 분석하면, 그 일차적인 숨은 의도는 성소수자의 법적 지위를 강화하기 위함으로 보인다. 차별금지법은 ‘차별’이라는 모호하고 주관적인 잣대로 국민들이 누리는 자유를 침해할 가능성이 크다. 특별히 표현의 자유, 종교의 자유, 기업활동의 자유를 심각하게 훼손할 것으로 보인다. 나아가 차별, 괴롭힘 등을 이유로 묻지마 진정이나 고소고발의 남발로 갈등사회가 더욱 확대되고 상호간의 불신을 초래할 것으로 생각된다. 인권위의 평등법시안은 종교단체, 종교교육, 종교적 양심의 측면에서 헌법상 종교의 자유와 직접 충돌한다. 특히 동성애, 동성결혼은 남녀의 결합을 통해 이룩한 가정만이 하나님이 정하신 유일한 결혼으로 믿는 기독교인의 종교적 양심에 배치됨으로 동성애, 동성결혼을 비판을 차별로 규정하고 민형사제재를 가하는 평등법시안은 기독교인의 종교의 자유를 심각하게 위협한다. 영국의 Ashers Bakery 사례나 미국의 MASTERPIECE CAKESHOP 사례는 동성애 차별금지와 종교의 자유가 충돌할 경우 무엇을 우위에 둘 것인가라는 문제를 정면으로 다룬 판결이다. 영국 대법원은 2018년 동성애자라는 이유가 아니라 “동성결혼 지지”라는 문언을 넣은 케이크 주문을 거절한 것이므로 성적 지향에 근거한 차별이라고 볼 수 없고 따라서 종교적 표현의 자유가 우선한다고 하였고, 미국 대법원도 2018년 다소 우회적이기는 하지만 동성결혼 축하파티에 사용할 케이크 주문을 강요하는 것은 종교적 양심에 반하는 행위를 강요하는 것이라는 취지로 종교의 자유 쪽에 우위를 두는 기념비적 판결을 하였다. 이러한 영국과 미국의 판결들은 인권위의 평등법 시안이 초래할 위험성을 경고한다는 측면에서 우리에게 많은 시사점을 던져주고 있다.

영문 초록

NHRCK’s Equality Act suggests a very plausible purpose of 'realization of an equal society without discrimination', but if the contents are closely analyzed, its primary hidden intention seems to be to strengthen the legal status of LGBTI people. The anti-discrimination law is likely to infringe on the freedoms enjoyed by the people with the vague and subjective standard of “discrimination”. In particular, it is likely to seriously undermine freedom of expression, freedom of religion, and freedom of business activities. Furthermore, do not ask for discrimination, harassment, etc. It is thought that the conflicting society will expand further and lead to mutual distrust due to complaints or abuse of accusations. NHRCK’s Equality Act directly conflicts with the constitutional freedom of religion in terms of religious organizations, religious education, and religious conscience. In particular, homosexuality and same-sex marriage are contrary to the religious conscience of Christians who believe that only the family achieved through the union of men and women is God-determined marriage. Therefore, the Equality Act that criticizes homosexuality and same-sex marriage as discrimination and imposes civil and criminal sanctions is the religion of Christians. Seriously threatens its freedom. The case of Ashers Bakery in the UK and the case of MASTERPIECE CAKESHOP in the US deal with the question of what to prevail in the event of a conflict between homosexual discrimination and religious freedom. In 2018, the Supreme Court of UK refused to order cakes with the words “supporting same-sex marriage”, not because they were gay, so it could not be considered discrimination based on sexual orientation, and thus freedom of religious expression took precedence. Although indirect, forcing an order for a cake for a same-sex marriage celebration was a monumental ruling that puts the upper hand on religious freedom with the intent of forcing an act contrary to the religious conscience. These rulings in Britain and the United States have many implications for us in terms of warning of the dangers of NHRCK’s Equality Act.
