가정폭력 행위자에 대한 회복적 사법 (갱생보호)에 관한 연구 - 감호위탁 처분 대상을 중심으로

국문 초록

본 연구는 최근 주목을 받는 가정폭력 행위자에 대한 재범 예방에 관한 연구이며, 감호위탁 처분을 통하여 폭력적 행위에 대한 성행 교정, 교육에 초점을 두고 개선방안을 제안하고자 한다. 본 연구에서는 가정폭력 행위자를 성행 교정할 수 있는 감호위탁 처분을 중심으로 제도의 현실태를 알아보고, 향후 가정폭력 행위자가 재범하지 않도록 하는회복적 갱생보호 지원의 방안에 대하여 다음과 같이 제언한다. 첫째, 한국법무보호복지공단으로 감호위탁 처분을 받은 가정폭력 행위자를 대상으로 별도의 성행교정 프로그램을 진행하여 범죄의 결과, 법률 규정의 의미를깨닫게 하는 것이 필요할 것이다. 둘째, 가정폭력으로 인한 피해자와의 적극적인 관계 개선을 위한 노력을 할 수있도록 기회를 제공해야 할 것이다. 셋째, 공단에서는 가족지원프로그램 등 다양한 지원 방법을 마련해서 가정폭력으로 인한 피해자가 보상받을 수 있도록 하고, 조속히 범죄의 두려움에서 벗어나도록 돕는 것이 중요하다. 넷째, 지역사회는 가정폭력 범죄 문제 해결을 위하여 적극적으로 친족 범죄 문제에 개입하는 것이다. 결과적으로 회복적 사법(갱생보호) 프로그램의 절차는 기존 한국법무보호복지공단의 갱생보호사업의 정형적 구조에 의하기보다는 지역공동체의 주도적 역할이 강조되어야 한다는 것이다. 기존의 갱생보호사업은 대상자의 자발적 참여 의사를 바탕으로 운영해 왔다면, 지금부터는 방향성을 전환하여 강제적으로 범부보호사업을 받아야 하는 대상자(감호위탁 처분 등)를 위한 다양한 프로그램 및 접근방식을 마련하기를 기대한다. 이러한 갱생보호사업의 다변화를 기반으로 가정폭력 행위자에 대한 회복적 갱생보호의 기틀이 마련될 수 있을 것이다.

영문 초록

This study is a study on the prevention of recidivism for perpetrators of domestic violence, which has recently received attention, and seeks to propose improvement measures by focusing on correction and education of violent behavior through custody entrustment. In this study, we examine the current state of the system focusing on the custody entrustment disposition that can correct the behavior of domestic violence offenders, and suggest the following measures to support restorative rehabilitation and protection to prevent domestic violence offenders from reoffending in the future. First, it will be necessary to conduct a separate sexual behavior correction program for domestic violence offenders who have been entrusted to the Korea Rehabilitation Agency to make them aware of the consequences of crime and the meaning of legal regulations. Second, opportunities should be provided so that efforts can be made to actively improve relationships with victims of domestic violence. Third, it is important for the corporation to devise various support methods, such as family support programs, to ensure that victims of domestic violence receive compensation and to help them quickly escape from the fear of crime. Fourth, the local community actively intervenes in the family crime problem to solve the domestic violence crime problem. As a result, the procedures of the restorative justice (rehabilitation protection) program should emphasize the leading role of the local community rather than relying on the formal structure of the existing rehabilitation protection project of the Korea Rehabilitation Agency. While the existing rehabilitation protection project has been operated based on the target's voluntary participation, from now on, we hope to change direction and prepare various programs and approaches for those who are compulsorily required to receive the general protection project (such as consignment to custody). Expect. Based on this diversification of rehabilitation and protection projects, a foundation for restorative rehabilitation and protection for perpetrators of domestic violence can be established.
