뉴노멀 시대 법무보호정책의 방향에 관한 소고 - 제21대 국회의 입법활동 검토를 중심으로

국문 초록

‘뉴노멀’이란 개념 하에 제21대 국회는 많은 입법활동을 진행했지만, 법무보호정책 관련 입법활동을 분석한 결과, 범죄자를 관리·감독하기 위한 목적의 입법활동을 중심으로 진행했고, 교화와 사회복귀를 위한 입법활동은 상대적으로 부족한 것으로 나타났다. ‘비대면’·‘언택트’로 상징되는 코로나19 시대의 ‘뉴노멀’을 반영한 듯, 전자감시시스템을 도입하는 등 다양한 관리 강화 방법을 모색했지만, 교화와 인권보호와 관련된 조문은 단순한 선언 규정으로만 그치기도 했다. 또한 관리·감독을 강화하고자 했지만, 이 업무를 운영하기 위한 지원 분야 규정의 개정은 미흡한 수준이었다. 즉, 제21대 국회의 법무보호정책 분야의 ‘뉴노멀’은 관리·감독 분야의 강화이자 엄혹했던 시절로의 복귀로 정리할 수 있는 것이다. 그러나 운영 지원 분야의 엄밀한 검토 없는 관리·감독의 강화는 그 목적을 달성하는데 가장 큰 장애요소가 될 것이고, 이 문제에 대한 제대로 된 인식이 없는 정책 입안은 더 혹독한 엄벌주의 정책으로 나아가는 악순환을 가져올 것이다. 그리하여 필자는 ‘뉴노멀’의 취지에 걸맞게 관리와 교화라는 양자 대립 구조에서 벗어나 그 전 단계인 법무보호정책의 운영에 대해 제대로 된 검토부터 다시 진행하는 것을 제안한다.

영문 초록

Under the concept of ‘new normal,’ the 21st National Assembly carried out many legislative activities. This paper analyzed the legislative activities related to the legal protection policy of the 21st National Assembly. As a result, it was found that the National Assembly focused on legislative activities aimed at managing and supervising criminals, and that legislative activities for rehabilitation were insufficient. As if reflecting the ‘new normal’ of the COVID-19 era symbolized by ‘non-face-to-face’ and ‘untact’, the National Assembly sought various ways to strengthen management, such as introducing an electronic surveillance system. However, the legal provisions on rehabilitation and human rights were limited to simple declaration provisions. In addition, although it was intended to strengthen the management and supervision of criminals, the revision of laws in the support field to operate this work was insufficient. In other words, the ‘New Normal’ in rehabilitation policies of the 21st National Assembly can be summarized as strengthening the management and supervision field and returning to the days of severe punishment. However, strengthening management and supervision without rigorous review of the operational support field will be the biggest obstacle to achieving that goal. And policymaking without proper awareness of this problem will lead to a vicious cycle of moving toward harsher punitive policies. Therefore, in line with the meaning of the word ‘new normal’, I first requests that we break away from the conflicting structure of management and rehabilitation. I also propose that we begin with a proper review of the operation of the legal protection policy, which is the previous step.
