헌법소원의 직접성 요건에서 문제되는 ‘집행행위’의 성격 및 범위 - 위원회 구성에 관한 조직규범을 중심으로

국문 초록

법령조항에 대한 헌법재판소법 제68조 제1항 헌법소원에서 직접성 요건 판단 시 문제되는 ‘집행행위’란, 헌법소원의 대상이 될 수 있는 ‘공권력행사성’을 지닌 것이어야 하며(집행행위의 성격), 위 행위에 대한 구제절차에서 재판의 전제성이 인정되어 해당 법령조항에 대한 위헌성 심사가 부수적으로 이루어질 수 있는 경우에 해당하여야 한다(집행행위의 범위). 위원회 구성에 관한 조직규범의 집행행위로 고려될 수 있는 것으로는, ‘위원회 구성행위’와 ‘위원회의 권한행사 내지 그에 터잡은 다른 기관의 권한행사’가 있을 수 있다. 이 중 ‘위원회 구성행위’는 집행행위의 성격 측면에서 문제가 되고, 분쟁을 조기에 해결할 필요성, 권리의무관계에 영향을 미치는 정도, 제소기간 등 사법구제를 인정함으로써 생기는 절차의 분단 등을 고려하여 공권력행사성 여부를 판단할 필요가 있다. ‘위원회의 권한행사 내지 그에 터잡은 다른 기관의 권한행사’는 집행행위의 범위 측면에서 문제가 되고, 위원회 구성에 관한 조직규범이 위헌으로 판단될 경우 위 권한행사에도 하자가 존재하게 되는지 여부가 집행행위에의 해당 여부를 판단하는 기준이 될 것이다. ‘위원회 구성행위’나 ‘위원회의 권한행사 내지 그에 터잡은 다른 기관의 권한행사’가 집행행위로 인정되는 경우, 위원회 구성에 관한 조직규범의 직접성은 원칙적으로 부정되고, 다만 직접성의 예외에 해당하는 사유가 있는지 여부가 판단되어야 한다. 이와 달리, ‘위원회의 권한행사 내지 그에 터잡은 다른 기관의 권한행사’가 집행행위로 파악될 수 없고, ‘위원회 구성행위’는 공권력행사성을 결여한 경우라면, 위 조직규범은 그 자체로는 물론 예정된 행위로도 청구인의 법적 지위를 변동시키지 않으므로 기본권침해가능성 자체가 부정된다는 결론에 이르게 될 것이다. 그동안 위원회 구성에 관한 조직규범을 다룬 헌법재판소 결정들은 구체적인 논증없이 결론만을 제시하거나 일부 논증 과정을 생략하였고, 이는 일관되지 못한 설시들을 낳게 되었다. 지금까지 정리한 논증 과정에 따라 보다 구체적이고 정치한 판단이 이루어질 필요가 있다고 하겠다.

영문 초록

For the “directiveness” requirement to be met in a constitutional complaint to a statutory provision under Article 68(1) of the Constitutional Court Act, the “enforcement action” at issue must be an “exercise of the governmental power” which can be the subject of a constitutional complaint(the characteristic of the enforcement action), and the constitutionality of the statutory provision must be able to be adjunctively examined by meeting the “prerequisites for judgment” requirement in a legal proceeding for the “enforcement action” at issue(the scope of the enforcement action). There are two types of actions which can be considered as enforcement actions of the organization clause for committee composition; (1) “the action of composing a committee” and (2) “the action of exercising the committee's authority or the authority of another body based on it”. Action (1) is problematic in terms of the characteristic of the enforcement action, and it is necessary to be considered the need to resolve disputes early, the extent of affecting the rights and obligations, and the division of procedures caused by recognizing separate legal proceedings, etc. Action (2) is problematic in terms of the scope of the enforcement action, and it is necessary to be considered, if the organization clause for committee composition is found unconstitutional, whether there would be a defect in action (2). If action (1) or (2) is recognized as the enforcement action, the “directiveness” requirement of the organization clause for committee composition would not be met in principle, but it must be determined whether there are reasons falling under the exception to the requirement. If action (1) and (2) cannot be recognized as the enforcement action, the organization clause for committee composition cannot change the legal status of a complainant, and therefore “infringement possibility of fundamental right” requirement would not be met. The decisions of the Constitutional Court of Korea dealing with the organization clause for committee composition have either presented conclusion without specific argumentation or omitted some of the argumentative processes, leading to inconsistent reasoning. It is necessary to make more specific and precise decisions based on the aforementioned argumentative processes.
