국문 초록

재정에 관한 국가 의사결정 과정의 불합리성, 그로 인한 결정 내용의 불합리성은 ‘정부실패’를 쟁점으로 제기한다. 이는 ‘시장의 실패’와 대비된다. 시장의 실패는 일부 기업의 독점적 시장지배, 부당거래, 소득분배 양극화의 문제를 발생시키고, 정부의 실패는 시장에 대한 규제와 조정이 원래 의도한 결과를 얻지 못하거나, 시장 실패를 더욱 악화시키기도 한다. 정부실패의 문제점을 강력하게 제기하고 나선 대표적인 사조가 신자유주의이다. 우리나라에서 전개되는 신자유주의는 사회국가원리, 즉 복지주의를 선언하고 있는 우리나라헌법 자체를 비판하는데 이르고 있다. 사회국가원리가 오히려 헌정질서. 국가발전에 장애라는 것이다. 현행 헌법 중 사회국가원리에 관련된 모든 조항을 폐지하는 헌법개정을 해야 한다고 주장한다. 구체적으로, 헌법 제119조 제2항 이하를 모두 삭제하자고 한다. 사회국가원리와 신자유주의는 ‘자유와 시장’을 바라보는 시각에서 엄청난 차이를 보인다. 신자유주의는 ‘규제와 조정이 없는 자유와 시장’을 추구하는 데 반하여, 사회국가원리는 ‘자유와 시장’이 합리적으로 운영되기 위해서는 국가의 규제와 조정이 필요하다고 본다. 여기에서 ‘자유와 시장’의 본질이 무엇인가라는 근본적인 질문이 제기된다. ‘자유와 시장’ 개념이 무엇인지, ‘자유’가 무엇이고, ‘시장’이 무엇인지를 확인할 필요가 있다. 특히, 이 글은 신자유주의자들이 자주 인용하는 ‘아담 스미스의 자유와 시장’ 개념을 검토한다.

영문 초록

The irrationality of the national decision－making process on finance and the resulting irrationality of the decision－making content raises ‘government failure’ as an issue. This contrasts with ‘market failure’. Market failure leads to monopolistic market control, unfair transactions, and polarization of income distribution. Government failure may lead to regulations and adjustments on the market not achieving the originally intended results, or may worsen market failure. Neoliberalism is a representative trend that has strongly raised the problem of government failure. The neoliberalism developing in Korea has led to criticism of the Korean Constitution itself, which declares the principle of social state and welfareism. The social－state principle is said rather an obstacle to constitutional order and national development. It argues that a constitutional amendment should be made to abolish all provisions related to the social－state principle of the current Constitution. Specifically, it is intended to delete all Article 119 (2) and below of the Constitution. The social－state principle and neoliberalism show a tremendous difference in their view of ‘freedom and market’. While neoliberalism pursues ‘freedom and market without state regulation and adjustment’, the social－state principle believes that state regulation and adjustment are necessary for ‘freedom and market’ to operate reasonably. Here, a fundamental question arises：what is the essence of ‘freedom and market’. It is necessary to confirm what the concept of ‘freedom and market’ is, what ‘freedom’ is, and what ‘market’ is. In particular, this article examines the concept of ‘Adam Smith’s freedom and market’ that neoliberals often cite.
