국문 초록

저작권 보호는 디지털 음악 산업의 발전에서 점점 더 중요한 역할을 하고 있다. 세계적으로 저작권 보호가 선진화된 미국과 같은 선진국들은 수십 년 전에 저작권 보호 강화를 주창하고 저작권 소유자의 권리를 보호하기 위해 상대적으로 완전한 저작권 집합 관리 시스템을 구축하였다. 그러나 가장 큰 디지털 음악 시장인 중국은 디지털 음악 저작권 보호에 뒤늦게 시작되었다. 따라서 이 논문은 미국의 디지털 음악 저작권 보호와 중국에 미치는 영향에 중점을 둔다. 첫째, 디지털 음악 저작권의 정의와 구분, 음악의 디지털 저작권과 그 차이점을 소개한다. 그런 다음, 본 논문은 중국의 디지털 음악 저작권 보호 현황을 분석하고 중국 보호의 문제점을 지적한다. 마지막으로 이 글은 미국에서의 디지털 음악 저작권 보호를 분석하여 중국의 디지털 음악 저작권 보호에 대한 세 가지 긍정적인 조치를 지적한다. 결론적으로 중국 음악 산업의 급속한 성장과 함께 음악 저작권을 보호하는 법률 및 정책도 점차 개선되고 있으며 중국은 디지털 음악 저작권 보호가 선진화된 선진국으로부터 배울 필요가 있다. 미국의 디지털 음악 저작권 보호 조치를 배우고 이를 둘러싼 국제 분쟁 사례를 분석함으로써 중국은 미래의 디지털 음악 환경을 개선하여 저작권 소유자의 경제적 이익을 보호할 수 있다.

영문 초록

Copyright protection plays an increasingly important role in the development of digital music industry. Developed countries , like America, with advanced copyright protection in the world have advocated for strengthening copyright protection decades ago and established a relatively complete system of copyright collective management to protect the rights of copyright owners. However, China as the largest digital music market started late in the protection of digital music copyright. Therefore, this paper focuses on the digital music copyright protections in America and their implications for China. First, it introduces the definition and division of digital music copyright and the differences between the digital copyright of music and it. Then, this paper analyzes the current situation of digital music copyright protection in China and points out the problems faced in the protection of China. Finally, this article points out three positive measures of digital music copyright protection in China through analyzing that in America. which makes double-entry bookkeeping come into being and further improved. In conclusion, Along with the rapid growth of China’s music industry, laws and policies that protect music copyrights are also gradually improving, it is necessary for China to learn from developed countries with advanced protection of digital music copyright. By learning from the measures of digital music copyright protection in the United Sates and analyzing international dispute cases surrounding it, China can better the environment of digital music in the future so as to protect the economic interests of right owners.
