국문 초록

인권 개념은 1948년 세계인권선언을 시작점으로 하여 국제적으로 보편화 되었다고 평가받고 있다. 세계화와 함께 찾아온 문화의 다양성과 확장은 보편적 인권 개념에 대해 많은 논쟁들을 야기했다. 70여년이 지난 지금까지 왜 문화와 인권 개념 사이의 갈등은 지속되는가? 기존 연구들은 문화의 보편론과 상대론, 보편적 인권의 존재에 대한 논의들이 주를 이루었다. 본 논고는 ‘관계성’이라는 새로운 관점을 ‘정치적 접근법’이라는 개념 분석 방법과 접목시켜 논쟁을 문화의 관계성과 인권 개념의 역동성을 통해 재조명해본다. 이를 위해 분석적 층위와 실행적 층위라는 두 가지 층위로 문화와 인권개념에 대해 분석함으로써 보편적 인권 개념에 대한 타당성 충돌이 문화권 내외부적으로 어떻게 나타나는지를 살펴본다. 특히 인권 개념과 문화 모두 유동적인 개념이라는 점에 주목하였다. 문화를 이루는 주체들은 상호 관계성에 따라 정치적 결정 과정을 거친다. 이 과정에서 발생하는 개념에 대한 해석(interpretation)을 통해 지속되는 논쟁의 원인을 다각적으로 분석할 수 있는 길을 제시하고 있다.

영문 초록

The universal expansion of the concept of human rights is considered to have begun with the 1948 Universal Declaration of Human Rights(UDHR). The expansion of diverse culture that came with globalization has caused much debate about the concept of universal human rights. More than 70 years after the UDHR, and the controversy between culture and human rights continues. Existing studies mainly take an either stance between universalism versus relativism in the conept of human rights. This paper combines a new perspective of relationism with a conceptual analysis method called political/critical approach to argue that the lasting controversy can be re-examined on the dynamics of cultural relationism and human rights concepts. To this end, we analyze the concept of culture and human rights in two scopes, the scope of analysis and the scope of practice, to see how the conflict of feasibility on the concept of universal human rights appears both inside and outside the cultural sphere. In particular, it is noted that both human rights concepts and cultures are fluid concepts. The cultural actors go through a political decision-making process that reflects their interrelationship. Interpretations of the concepts that arise in this process provide an alternative way to analyze the causes of the ongoing debate.
