국문 초록

본 연구는 선행 문헌 고찰을 통해 사립대학들의 현행 총장선출제도의 문제점을 진단한 다음 이러한 문제점을 해소할 수 있고 헌법질서에 부합함은 물론 대학의 발전을 도모할 수 있는 바람직한 사립대학 총장선출제도를 제시할 목적으로 이루어졌다. 우선 대부분의 사립대학에서 총장 선출 과정에 대학 구성원들의 참여가 완전히 배제되고 있는데 이러한 현행 제도에 헌법적으로나 현실적으로 어떠한 문제점이 있는지 진단해본다. 그리고 이러한 대학 구성원들의 참여 배제 문제를 해결하기 위하여 대학에는 자율성이 헌법에 의하여 보장되고 있는데 대학 구성원의 총장 선출권은 이러한 대학의 자율성의 핵심적 요소임을 밝힘으로써 구성원들에게 총장 선출에 참여할 수 있는 헌법적 권리가 있음을 규명하였다. 사립대학 구성원들에게 총장 선출에의 참여권을 보장하면 필연적으로 학교법인의 사학 경영의 자유에 따른 총장 선출권과 충돌이 발생하게 되는데 충돌하는 두 기본권 모두를 최소한으로 제한하고 최대한으로 보호할수 있는 합리적 방법을 모색하였다. 이러한 과정을 통하여 사립대학 총장 선출의 바람직한 방법을 제시하였다.

영문 초록

This paper was written to diagnose the problems of the current presidential election system of private university, and to suggest a desirable alternative electing system which can solve the problems and correspondent with constitutional law and promote the development of the university. For a start we diagnosed what is constitutional and practical problems with current presidential election system of private university which excludes the member of university``s participation in the presidential election process completely. And we studied that the members of the private university have the constitutional right to participate in the presidential election process. By the way the guarantee of the member``s fundamental rights to participate consequentially results in the collision of the fundamental right to appoint the president of the private university of the educational foundation. So we tried to find a reasonable solution which minimize the restriction and maximize the of both rights. And we suggested a method of an presidential election of the private university through that finding process.
