교육감 선출제도의 쟁점 분석-헌법재판소의 결정례를 중심으로-

국문 초록

이 글에서는 교육감의 자격요건과 선출방식에 한정하여 교육감 선출제도를 헌법재판소의 판례를 기반으로 검토하였다. 교육감의 자격요건은 경력년수의 축소와 정당원의 아닌 기한의 축소 등 계속하여 완화되어 왔는데, 이는 교육감 피선거권자의 공무 담임권을 확대한다는 의미를 가진다. 그러나 교육경력 또는 교육행정경력을 완전히 폐지하지 않고 여전히 3년의 교육경력 또는 교육행정경력을 요구하는 것은 지방교육 자치제의 전문성의 원리를 상징적으로 보장하는 것으로 볼 수 있다. 교육감의 선출 방식은 2006년 「지방교육자치에 관한 법률」의 개정을 통해 간선 제에서 주민직선으로 변화되었다. 교육감의 주민직선제는 주민들의 선거권을 확대하고, 교육감의 주민대표성을 증대시킴으로써 주민통제의 원리라는 지방교육자치의 정신을 실현하는 제도로 볼 수 있다. 교육감 선출제도가 국회의 입법재량 사항이라고 할지라도 특정 정당의 유.불리에 따라서 그 때 그 때 그 방식이 바뀌는 것은 바람직하지 않다. 교육감 선출제도를 변화시키려고 할 때 무엇보다도 중요한 것은 헌법이 보장하는 주민통제의 원리, 정치적 중립성 등 지방교육자치의 정신을 제대로 구현할 수 있는 제도인가라는 점이다. 분명 주민직선제가 절대 훼손할 수 없는 불변의 제도는 아니라고 할 수 있지만, 제도적인 안정성을 유지하면서도 교육감 선출 과정 중에 나타나는 문제점을 해결해 나갈 수 있을 것이다.

영문 초록

The purpose of the article was to review election system of the Superintendent with the constitutional values, and the results are as follows: Qualification of the Superintendent candidates has been continued to ease. It led to expand the people’s right to hold the public office. But three years of ‘education career’ or ‘education administration career’ still remains as the requirement, and this could be understood as a symbolic guarantee of the principles of professionalism of local educational autonomy. The election system of the Superintendent was revised from ‘indirect’ to ‘direct’ since 2006 by the revision of the “Local Education Autonomy Act.” Since then, the Superintendent is elected directly by residents or people. It is clear that the direct election system of the Superintendent enhanced the people’s right to vote and its representative-ness of the residents. Therefore, the current election system could be accepted as the best way to fulfil the genuine meaning or value of the local education autonomy.
