외국인의 토지취득 제도와 관련법에 관한 연구

국문 초록

본 연구에서는 외국인의 토지취득 제도에 대해 알아보고, 관련 법률인 외국인토지법과 외국인투자촉진법을 중심으로 주요 쟁점별로 분석하여 외국인 토지취득제도에 대한 시사점을 제시하였다. 첫째, ‘외국인토지법’에서 상호주의를 채택하고 있으나 이미 헌법에서 내외국인 평등주의를 취하고 있으므로, 외국인토지법의 상호주의는 WTO 체제하의 최혜국대우원칙으로 전환할 필요가 있다. 둘째, ‘외국인토지법’에서는 외국인이 국내에서 토지취득시 원칙적으로 신고주의를 취하고 예외적으로 허가주의를 채택하고 있으나, 이미 정보화의 진전으로 외국인의 토지보유현황이 수시로 파악되고 있어 신고주의를 취할법적 의미가 약해졌다. 셋째, ‘외국인투자촉진법’에서는 외국인토지 이용권을 최대 50년까지 그 범위를확대할 수 있도록 개정하였으나, 실행단계에서 시행착오를 거치면서 우리나라 실정에 맞도록 수정․보완되어야 한다. 넷째, 외국인투자는 순기능과 역기능을 동시에 가지고 있으므로, 순기능은 장려하고 역기능에 대해서는 적절한 투기방지책 등을 마련해야 할 것이다.

영문 초록

The objective of this paper is to develop some implications of the land acquisition system of foreigner in the 'Foreign Land Act' and 'Foreign Investment Promotion Act'. 1) The Foreign Land Act guarantees land-property right of foreigner in accordance of reciprocity, however, Korean Constitution guarantees the property right of foreigner as well as nation. Therefore, the principle of reciprocity of the Act needs to convert into the most-favored-nation treatment policy of the WTO. 2) The Foreign Land Act conversed its permit of foreign land-holding into reporting system, with some exceptions to the military preservation zone and so on. But the legal meaning of reporting system became weak because the land holding status of foreigners would already grasp in the computer program system. 3) The Foreign Investment Promotion Act guarnatees the foreigner land right to operate by the year 50, so we need try to fit for the Korean business environment 4) There are the positive and negative functions in the foreign direct investment together, we will to promote of the positive function and to manage of the negative.
